WHEREAS, the City Plenning Commission did hold a public hearing et the City Hall in the City of Anaheim
on October 149 19639 et 2:00 o'clock P.M., rtotice of seid public hearing having been duly given es required
by law and in accordance with the provisions of the Meheim Municipel Code, Chapter 18.68,to hear ond consider
evidence for end against said proposed veriance end to invesugate and make findings and recommendation~ in connec-
tion the:ewith; end
WHEREAS, seid Commission, after due inspection, investigation, and study made by itself end in its behalf,
end efter du~_conside:ation of ell evidence and ceports offered as seid hearing, does find and determine the following
facts:
1. That the pe:itioner cequests a varience from the Anaheim Municipel Code: Seotions18.32.060, whiah
siipulates a one-story reight requiremen~; 18.32.120(1), whiah requires 1~ garages per
daelling unit, to oonstruot an apartment buiZding with aerports.
2. That the:e a:e exceptional or extreordinary circumstances or conditions eppliceble to the property involved
or to the intended use of the property that do r.ot apply generally to the property or class of ase in the seme vicinity
and zone. ~
3. That the requested varience is necessery for the preservation end enjoyment of a substentiel property right
possessed by other property in the seme vicinity end zone, snd denied to the property in question.
4. 'fhat the requested veriance will not be meterially detrimental to the public welfete or injurious to the prop-
erty or improvements in such vicinity pnd zone in which the property is loceted,
5. `i'1•iet the request for waiver ef the struatural height limitaticn of one-story within
150 feet of R•-A, Residential Agrioultur.el zoned property as •reqnired in Code: Seation
1B.32.060, is hereby der_ied, because the proposed two-stor,v construc~ion is ~rithin 150 fset

6. That the petitioner, by stipulation, agreed to oonstruat a 6-foot masonr~y we,ll
at the westerly end of the proposed 30-foot drive, exaept for a walkway.
7. That no one eppeared ir. opposition to subject petition.

NOW, THEREFORE, BE IT RESOLVED thet tke Aneheim City Plenning Commission does hereby grant subject
Petition for Veriance, upon the following conditions which are hereby found to be a necessery pcecequisite to the pro-
posed use of the subject p:operty in order to preserve the safety and general welfere of the Citizens of the City ot
Anaheim.
1. Lhat the sidewalks shall be installed along Harbor Boulevard as required by the City
Enginesr, and in aaaorde,nae with standard plans and speoifioations on file in tha o£f.ice
of the City Engineer prior to final building inspectiono • '
2o That the owners of subject property sha.ll pay to the City of Anaheim the sum of $~5.000
per dwelling unit to be used for park and recreation purposes, said•amount to be paid at the
time the building permit is issuede
3e That trash storage areas shall be prouided in accordance with approved p,lans on file in
the office of the Director of Public Works, prior to finaZ building inspection.
4o That this Variance is granted subject to the completion of Reclassification Noo63-6~-44a
5o That the'vehicular access rights to Bellevue Drive from the proposed 30-foot drive be
dedicated to the City of Anaheim, and that said dedication shall be complied with within a per-
iod of 180 days from date hereof, or such further time as the City Planning Commission may
granto
