THAT PETITION FOR CONDITIONAL USE PEI2MIT 493 BE GRANTED
WHEREAS, the City Planning Commisaion of the City of Aaeheim did recei•ee a verified Petition for Conditionel
~se Permitftom ELBERT L. & LIDA SMITH, 12921 Wheeler Place, Santa Ana, California, Owners;
HARVEY HIERSy et al, 70i East Buffalo Avenue, Santa Ana, California, Agent of certain
real property situated in the City of Anaheim, County of Orange, State of Califo•rnia,
described in Exhibit "A" attached hereto and referred to herein as though set forth in full

WHEREAS, the City Plenning Commiesion did hold a public hearing at the City Hell in the City of Anekeim on
October 28~ 19639 et 2:00 o'clock P.M., notice uf said public hearing having been duly given as required by
lew and in accocdence with the proviaions o£ the Aneheim Municipal code, Chapter 18.64, to hear end consider evidence
for and ageinst said pcoposed conditional use and to investigate and meke fiadings and ~ecommendetions in connection
therewith; and •
WHEREAS, seid Commission, eftet due inspectioa, iavestigation, end study' made by itself end in ita behalf, and
efter due consideration of ell evidence end reports offered at seid headng, does find and determine the followiag fects:
I. That the proposod use is pcoperly oae for which a Conditional,Use Pecmit is authorized by this Code, to
wit: establish a.i91-unit motel on subject property.
2. That the p:oposed use will aot advecaely affect.the adjoining lend uRes end the gcowth end development of
the azea in which it is propoaed to be located.
3. That the size and shape of the site ptoposed for the use is edequate to allow the full development of the
proposed use in a manner not detrimental to the pecticulaz erea nor to the peace, health, aefety, end general welfare
of the Citizens of the City of Anaheim. .
4. Thet the gcenting of the Conditionel Use Permit under the conditlons imposed, iE any, wiil not he detcimental
to the peace, health, sefety, and gene:al welfece of the Citizens of the City of Aneheim.
5o That no one appeared in opposition to subject petition.,

NOW, THERF.FORE9 BE IT RESOLVID that the Anaheim City Plannircg Commission does..hereby grant
sub~ect Petition for Conditional Use Permit, upon the following conciitions which are.hereby
found to be.a necessary prerequisite to the proposed use of the subject property in order to
preserve the safety and general welfare of the citizens of the City of Anaheima 1
la That the owners of subject property sha11 deed to the City of Anaheim a strip of land ~
forty-five (45) feet in ~,vidth, from the centerline of the st:eet, along Manchester Avenue9
f.ncluding a twenty-five (25) foot radius corner return, for street widening purposes. '
2a That street improvement plans shall be prepared and all engineering requirements of the
City of l,naheim along Manchester Avenue, such as curbs and gutters, sidewalks, street grading
and paving, drainage facilities, or other appurtenant work shall be completed as required by the
City Engineer and in accordance with standard plans and specifications on file in the office
of the City Engineer; and that a bond in an amount and fprm sat:sfacto;y to the CiLy or' nnaheim
shall be posted with the City to guarantee the installation of said engineering requirements.
3o That the sidewalks shall be installed along Harbor Boulevard, as required by the City
Engineer and in accordance with standard plans and specifications on file in the office of the
City Engineero
4o That the owners of subject property shall pay to the City of Anaheim the sum of $2000
per front foot, along.Manchester Avenue for street lighting purposeso !
5o That trash storage areas shall be provided in accoxdance with approved plans on file
in the office of the Director of Public Works, prior to final building inspectiono
6o That fire hydrants shall be installed as required and determined to be necessary
by the Chief of the Fire Department,, to be installed prior to final building inspection. '
7. 1'hat Condition Nos< 1, 2, 3, and 49 above mentioned, shall be complied with within a
period of 180 days from date hereof, or such further time as the Co~nnission may grant.
So That sub3ect property shall be developed in accordance with Exhibit Nos. 1, 2, 3, and 4. '
9o That all air-conditioning facilities shall be properly shielded from view from the
abutting strQets and the proposed h:.gh-rise building to the southeast of subject property,
10, That tree wells shall be provided,at approximately 40-foot intervals in the Harbor
Boulevard and Manchester Avenue parkwa,ys abuttin sub'ect
wells and planting of trees thereinysh~ll be submitted to and a~tY' that plans for said tree
•of Parkway Maintenance; and said tree wells sha11 be planted withrtreesbY the Superintendent
building inspectiona prior to final
