RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT

WHEREAS, the City Planning Commiasion of the City of Anaheim did receive e verified Petition for Reclessifica-

in Exhibit "A" attached hereto and referred to herein as though set forth in full

WHEREAS, the City Planning Commisaiort did hold e public headng at the City Hall in the City of Anaheim on
October 28~ 1963, at 2:00 o'clock P.M. notice of said public he~+ring heving been duly given us required by
law end in accordeace with the provisiona of the Aneheim Municipel Code, Chepter 18.72, to hear end consider evidence
for end egalnst said ptoposed :eclessificetion and to invesUgate and make fIndings end recommendationa in connection
therewith; end
WFiEREAS, seid Commiasion, eftec due inspection, investigetlon, end study made by itself and in its behalf, end
efter due conslderatlon of all evidence and reports•offeced et said hearing, does find and determine the followIng fecta:
1. That the petitioner propoaea a reclessificatIon of the ebove described property from the R-39 N;:altiple
fiamily Residential, Zone to the C-3, Heavy Commercial, Zone to establish a new and used
car ege:~cy as a conforming use and to permit its expansiono
2. That the pcoposed reclessificetion of subf ect pxoperty is necessery end/or deairable for the ocderly end pro-
per development oE the commun1ty.
3. That the proposed reclessificetion of aubject property does properly relete to the zones and their permitted
usea 2ocelly established in close p:oximity to aubject z~roperty and to the zones and their permitted uses gene:ally estab-
lished throughout the community.
4o That the proposed reclassificat'Lon of subject property does require dedication for
and standard improvement of abutting streets because said propoerty does relate to and
abut upon streete and highways which are proposed to carry the type and quantity of traffic9
which will be generated by the permitted usesy in accordance with the circulation element
of the General Plano

NOW, THEREFORE, BE IT RESOLVED thet the Anehelm City Pleaaing Commission does heroby cecommend
to the ~ity Council of the City of Anaheim 4hat subf ect Petition for Reclasaificatior. be appcoved and, by so doing;
thet Title !&Zoaiug of the Aneheim Municipel Code be emended to exclude the above described pmperty fenm the
R-39 klultiple Fami~y Residential9 Zone and to incorporate said described property into the
C-3, Heavy Commercial9 Zone upon the follovring conditions which are hereby found to be a
necessary prerequisite to the proposed use of subject property in order to preserve the safety
and generai welfare of tne citizens of the City of Anaheim„
lo That the owners of subject property sha11 deed to the City of Anaheim a strip of land
forty-five (.45) feet in width, from the centerline of the street9 along Los Angeles Street,
including a 15-foot radius corner return9 for street widening puiposesa
2o That trash storage areas shall be provided in accordance with approved plans on file
in the office of the Director of Public Works, pr.ior to final buildiny inspectiono
3o That Condition Noo 1, above.mentioned9 shail.be complied tvith within a period of 180
days from date hereof, or such further time as the City Co~nc31 may granto
4o That subject praperty shall be developed substantiallp in accordance with plans and
specifications on f ile with the City of Anaheim, marked Exhibit Nosa i and 2a
5o That the ovrners of subject praperty shall p~ace of. record City of Anaheim Dezd Restric~
tions, approved by the City Attorney9 ~vhich restrictions sliall limit the use of sub3ect property
for a new and used car dealership only, with all services 3ncider~tai thexeto, and any C-2,
General Commercial, Zone uses, and that said restrictions shall be recorded within a period
of 180 days from date hereof, or such further t3me as the City Council may granta
