7. That it is recommended to the City Council that Condition No. 4 of Ordinance Noo 1266, j
~` dated June 3,'1958, which reclassified a portion of subject property to the C-1, Neighborhood i
Cotmnercial, Zone under Reclassification Noe 57-58-52, be amended to require a 20-foat frbnt { a
setback from Euclid S.treet. :
8. That the petitioner stipulated that the proposed theatre together vrith parking ~
^ provided at the rate of one space per each five seats would constitute the first phase of ~ i
'~ deuelopment, and that the proposed ten story office builc~ing together with the remainder ~f ~
z the prcposed parking area would constitute,the second phase of development. ~ 3
i' ' 9e That under the authority of Codet Section 18.64.070, waiver af the 35-foot height ;
limitation as stipulated in Codes Sections 18e40,fl20 is hereby granted~ ; :~
10. That under the authority of Codes Section 18e64.070, the required 557 parking spaces j ~
f or the proposed ten-story office building and the,additional 135 parking spaces for the
-- prr.pased theatre are deemed to comqly with t}ie provision of a total of 470 parking spaces for
~'~ the proposed facilities, on the basis that only 335 parkinq spact~s would be required for the '
;~' ten-story off ice building under the recently adopted parking standards of the C-0, Commercial .~
~_ Office, Zone, and that adequate parking.will be available for the office building during ~ :
; business hours, and for the theatre during evening entertainment liours. j i

NOW , THE"iEFORE9 BE IT RESOLVED that the Maheim City P.lanning Commission does hereby
grant subject Petition for Condi-L•ional Use Permit, upon the following conditions wh~ch are
hereby Found to be a necessary prerequisite to the prnposed use of the subject property in
order to preserve the safety and general welfare of the Citizens of the City of Anaheimo
le That the owners nf subject property shall pa;• tc the City of Anaheim the sum of
$2000 per front foot, along Euclid Street, for the southerly 147a11 feet only, for street
lighting purposesa
2< T:~at trash storage areas shall be provided in accordance with approved plans on
file in the office of the Director of Public Works, orio•r to final building inspectiono
3. That Condition No., 19 above mentioned, shall be complied with within a period of
180 days from date hereof, or such further time as the Commission may granto
4. That this Conditional Use Permit is qranted subject to the completion of
Reclassification No~ 59-60-5 provided that a condition to the ordinance, reclassifying
subject property be made9 in order to establish a minimum 20-foot setback on said propex•ty,
consistent with the recommended amendment to Condition No~ 4 of Ordinance Noo 12669 which
would reduce the setback from Euclid Street from 35-feet to 20 fee±o
5o That sub,ject property shall be developed substantially in accordance with plans and
specif ications on file with the City of Anaheim, maxked Exhibit Noe Iy provided that the
proposed 20-foot setback shall be maintained on the entire sub3ect propertyo
6o That a six-foot masonry wall shall be constructed along the east and north boundaries
of subject pruperty where adjacent to residential zoned property, except that an opening may
be left on the east property line for access to the abutting property to the east, prior to
final building inspection.
7. That tree-wells sha1Z be provided at approximate 40-foot intervals in the Euclid
Avenue parkway abutting subject propert~; that plans for said tree wells and planting of
trees therEin, shall be submitted to and approved by the Superintendent of Parkway Maintenance;
and said tree wells shall be planted with trees prio•r to final building inspActiono
8. That all air-conditioning facilities shall be contained within the building or
properly shielded from viewo
9. That the Euclld Avenue frontage of subject property shall be landscaped and
maintained as indicated on Exhibit Noo 1 on file with the City; that plans for said land-
scanina sha11 be submitted to and apnroved bv the Supe•rintendent of Parkway Maintenance9
and that said landscaping shall be installed prior to final building inspectione
l0o That one parking space for each five seats in the proposed theatre shall be provided
in conjunction with the theatre or first phase of development of subject property, and that
the ~smaining aa•rki,nd area as shown on Exhibit Noe 1~ sha11 be provided in conjunction with
the office builrling, or second phase of development of sub9ect propertyo
