WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition for Reclessifica-
tionfrom GIACOMO and AGOSTINA LUGARO, 532 North Magnolia Avenue, Anaheim, Cali.fornia, Owners;
TALT, MAC.MAHON 8 NELSON, 1695 West Crescent Avenue, Anaheim~ California~ Agents of certain
real property.situated in the City of Anaheim, County of Orange, State of California,
described as the Westerly 275053 feet of the Northwest quarter of the Southwest quarter of
!~ Section 7, in Township A SoutHy Range 10 West, ~S,B,BeBM,, as shovm on a map recorded in
book 49, page 50, Record of Surveys, in the office of the County Recorder of said Orange
` Caunty, EXCEPTING TI-~REFROM the Northerly 649000 feet; ALSO EXCEPTING THEREFROM the Southerly

WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Meheim on
DeCember 23~ 1963 at 2:00 o'clock P.M. notice oE said public hearing having been duly given es required by
law and in accotdence with the provisions of the Anaheim Municipal Code, Chapter 18.72, to hear and consider evidence
for and against said ptoposed ceclassification and to investigate and make findings and cecommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and
after due consideretion of all e••idence end repocts offeced et said hearing, does find and determine the following facts:
1. 1;iat the petitioner proposes a ceclassification of the above described property from the R-A~ Residential
Agricultural, Zone to the C-1, Neighborhood Commercial, Zoneo
2. That the proposed reclassification af subject property is necessary and/or desireble for the orderly end pro-
per ~evelopment of the community.
3. Thet the proposed reclessificetion of subject property does properly relete to the zones and their permitted
uses locelly established in close proximity to subject property and to the zortes end their permitted uses generally estab-
lished throughout the community.
4o That the proposed reclassification of subject property does require dedication
for and standard improvement of abutting streets because said property does relate to and
abut upon streets and highways which are proposed to carry the type and quantity of traffic
which will be generated by the pern~itted uses, in accordance with the circulation element
of the General Plano
5o That no one appearei3 in opposition to subject petitiono

t- NOW, THERL•FORE, BE IT RESOLVED that the Anaheim.City Plannirg Commission does hereby
s recommend to the Ci.ty Council of the City of Anaheim that subject Petition for Reclassification
be approved and, by so..doing, that Tit1e.18-Zoning of the Anaheim Municipal Code be amended to
exclude the above described property from the R-A, Residential Agricultural, Zone, and to in-
corporate said described property into the C-1, Neighborhood Commercial, Zone, upon the follow-
"` ing conditions which are hereby found to be a necessary pxerequisiste to the proposed use of
subj~ect property in order to preserve the safety and general welfare of the citizens of the
City of Anaheimo
-;: r lo That the owners of subject property shall deed to the City of Anaheim a strip of land
53 fEet in width from the centerline of the street along Magnolia Avenue for street widen3ng
~.:' purposeso •
2o That street improvement plans shall be prepared and all engineering requirements of
the City of Anaheim along Magnolia Avenue, such as curhs and gutters, sidewalks, street grading
and pavin9, drainage facilities, or other appurtenant work~ shall be completed as required by
the City Enginesr and in accordance with standard plans and specifications on file in the office
of the City Engineery and that a bond in an amount and form satisfactory to the City of Anaheim
shall be posted v~ith the City to guarantee the instailation of said engineex•ing requirementso
3o That the owners of subject property shall pay to the City of Anaheim the sum of $2000
per front foot along Magnolia Avenue for street lighting purposeso
4o That trash storage areas shall be provided in accordance with approved plans on file
in the office of the Director of Public Works prior to final building inspectiono
5o That the owner of subject property shali deed to the City of Anaheim a 3-foot public
utility easement, and a 2-foot overhang easement along the easterly boundary of subject proper~y
60 :hat Condition Noso i, 2, 3 and 5y above mentioned, shall be complied with within a
period of 180 days from date hereof, or such further time as the City Council may granto
7o That subject property shall be developed substantially in accordance with plans and
specifications on file with the City of Anaheim9 marked "Exhibit Nose 1 and 2"0
8~ That tree v~ells shall be provided at approximate 40-foot intervals in the Magnolia
Avenue parkway abutting subject property; that plans for said tree wells and planting of trees
therein, shall be submitted to and approved by the Superintendent of Parkway Maintenance; and
said tr~e wells shall be planted with trees prior to final building inspectiono
9o That a 3-foot strip of land shall be landscaped on the Magnolia Avenue frontage and
said landscaping maintained, as indicated on Exhibit No~ 1 on file with the City; that plans

tenance; and that said landscaping shall be installed prior to final building inspectiono
l0o That a 6-foot masonry wall shall be constructed along the east and south property
lines prior to final building inspectiono
llo That all air-condit~oning facilities shall be property shielded from view from abut-
ting streetso
12o That the petitioner shall file a Petition for Reclassification or Variance on the
R-A, Residential Agricultural, Zone "not a part" parcei abutting to the south prior to final
building inspectiono
