SERIES 1963-64 A RESOLUTION OF THE CITY PLANNING O~MMISSION OF THE CITY OF ANAHEIM RE~MMENDING TO THE CITY ~UNCIL OF THE CITY OF ANAHEIM AN AMENDMENT TO TITLE 189 SECTION 18052 OF THE ANAHEIM MUNIC]PAL NDEo WHEREAS the City Council of the City of Anaheim, on February 5, 1963, pursuant to Ordinance 1811, did amend Chapter 18052 of the Anaheim Municipal Code "M-1, Light Industrial Zone", to provide for a 50 foot landscaped setback area on all arterial streets and highways, and WHEREAS said City Council9 on November 5, 1963, pursuant to Resolution 63R-~869, did adopt the General Plan for the City of Anaheim, which plan reflects city policy of encourag- ing and requiring landscaped setbacks along arteriai highways and, pursuant to Resolution 63R-870y did amend the Circulation Element of the General Plany which provides for. a new class of arterial streets: "Co'llector Streets"9 and WHEREAS Chapter 18~52, therefore4 requires a 50-foot landscaped setback on all collector streets, and . WHEREAS the 50-foot restriction imposes an unnecessary hardship on persons wishing to develop properties fronting on collecior streeis in Hnaheim°s inciustrial ar2as~ and WHEREAS Ordinance 1526 did establish a 25-foot landscaped setback on Cerrit~~ and Lewis Streets in the southeast industrial area, which setback the Planning Commission finds to be an acceptable precedent, and WHERFAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on January 20, 1964 at 7s00 o°clock pomo, notice of said public hearing having been duly given as required by law and in accordance wlth the provisions of the Anaheim Municipal Code, to hear and consider evidence for ancl against said proposed amendment and to investigate and make findings. and recommendations in connection therewith, NOW THERF~DRE BE IT RESOLVID that the Planning Commission of the City of Anaheim does f ind and determine that although said 50-foot landscaped setbac!c is too restrictive on highways of the collector classification9 ihe mainienance and enha~~cament of the high quality of Anaheim's industrial areas requires some minimum landscaped setback on arterial highways and does recommend to the City Council that Chapter 18052.060(2) be amended to read as follawss "18o52v060(2)(~~s An open setback area extending for the full width of the subject property shall be provided along those properties in all Anaheim industrial areas which abut upon an arterial highway as designed on the Circulation EJ.ement of the General Plan -"Arterial Streets and Hiyhways" as adopted and as amended from time to timee Said setback area shall be a minimum of fifty (50) feet in depth for all maior orimarv and secondarv hiqhwavs, and twentv-five (25) feet for all collec~Eor Streetsy measured from the planned highway right-of- way line as designated on the Circulation Element of the General Plan "Highway Rights-of-Way". "18.520060(2)(b)s The front twenty (20) feet of said fi£tv ~50) reet setback area and all of the twentv-five (25) feet setback area shall be landscaped with lawn, treesY shrubs or other plant materials and shall be permanentlymaintained in a neat and orderly manner as a condition to use. Fountains, ponds9 sculpture, planters, walkways and decorative screen type wall,, thirty (30) inches or less in height, where an integral part of a landscaping scheme comprised primarily of plant materials9 are permitted. Entrance and exit drives and walks may be provided into parking areas. Said drives shali not exceed thirty (30) feet in width for each curb opening".
