law and in eccocdence with the provisions of the Maheim Municipc+l code, Cheptec 18.64, to hear end consider evidence
fer end egeinst snid proposed conditionel use and to investigete and make fiadings end zecommendations ia connection
therewith; and •
WHEREAS, aeid Commiesion, aite: due inapection, investigetion, and atudymade by itself end in its behalf, end
after due consideration of all evideace end teports offeted at said headng, doea find end determiae the following facts:
i. That the pmposed nse is pt~perly one for which a Canditionel.Use Peeinit is authoctaed by this Code, to

2, Thet the proposed use will not advezsely affect,the edjoiaiag land uses and the gmwth and development of
the azea in which it is pmposed to be located.
3. That the size end ahepe of the site proposed foe the use is edequate to allow the full develoQment oF the
proposed use in a menner not detdmentel to the particular acea nor to the peace, health, saEety, end genaral welfare
of tha Citizens of the City of Annheim. .
4. Thet the granting of the Cond:tionel Use Permit under We conditlons imposed, if eny, will not be detrimental
to the peece, health, sefety, and genecel wel£ere of the Citizens o: the Cit~~ of Annheim.

the safety and.general welfare of the Citizens oF the City of Rnaheim.
k 1> That the owner of subject property shall deed to the City of Anaheim a strip of land
60-feet in width, from the cent~r litte of the streety along Brookhurst Street, including a
corner cutoff, for street widening purposese
2o That the sidewalks shall be installed along Brookhurst Street and Lincoln Avenue, as
required by the City Engineer and in accordance with standard plans and spECifications on file
in the office of the City Engineer prio.r to final building inspectiono (The sidewalk along
Brookhurst Stxeet shall be 10-feet wide from curb face as shown on Exhibit Noe lo )
3o That the City of P.r.aheim grant a temporary encroachmant permit for one pump island,
including canopy, along the Brookhurst Street frontage~
4a That the driveway locations shall be approved by the City Engineer prior to the issuance
of a buildina permito
~ 5o Thai i;rash storaqe areas sha11 be pr~vided in accordance with approved plans on file
•:, in the office of the Diractor of Public Works, prior to final building inspectiono
6o That the owner nf subject property shall dee ' to the City of Anaheim a 5-foot public
utility easec~ent along the southerly bpundary of subject propertyo
7o That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per
front foot9 along Brookhurst Street and Lincoln Avenue, for street lighting purposeso
8a That Condition Nos~ 1, 6 and 7, above mentioned9 shall be complied with within a period
of 180 days from.date.hereofy.as.s.uch..further time._as the Commission may grant.
9o That subject property shall be developed substantially in accordance with plans and
; specifications on file with the City of Anaheim, rnarked "Exhibit Noso 1, 2 atid 3," as amended
hexein,.and f.urther provided that subject property shall be developed sLbstantially in accordance
with adopted Service Station Minimum Site Development Standardso
10, That a written agreem~nt shall be submitted to and approved by the City Attorney9 said
agreement stipulating the length of time the encroachment of the pump island, canopy9 and piping
shall be permiited9 the r.esponsibility for their rernoval and any liability incurred thereto, on
the dedicated portion of the Brookhurst Street frontage of subject propertyy and that saicl
agreement shall be recorded in the offics of the County Recorder prior to final building
inspectiono
