A RESOLUTION OF THE CITY PLANAJING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 1.~58._.BE GRANTED
WHEREAS, the City Plenning Commission of the Ciry of Aneheim did initiate a verif ied Petition for
Variance on certain real property situated in the City of Anaheim, County of Orange, State
of California, as described in Exhibit "A" attached hereto and referred to herein as though
set forth in fu21
Property owned by: Sunshine Biscuits, Incorporated, P. 0. Box 1192, 2910 Thomson Avenue,
Long Islar.d City, New York, and Pacific Electric Railroad, 610 South
Main Street, Los Angeles, Californiao
; and
WfiEREAS, the City Plecining Commission did hold a public heering et the City HaA in the City of Aneheim on
August 31~ 1964, at 2:00 o'clock P.M., notice of seid public heedng heving been duly given es reqaired by
law end ln ecoadmue with the pmvlsions of the Anaheim Municipel Code, Chapter 18.68, to heer end conside~ evidence for
and against said praposed vaziance ~nd to lnvestigate ead meke findings end recommendations in connec!ion therewith;
and
WHEREAS, setd Commission, after due inapection, investigetion, and study mede by itself end in its behelf,
end efter due consideretion of all evidence end repods otfered es seid headng, does find and detecmine the following
fects:
1. Thatthe Planning Commission proposes a variance from Ordinance No, 1526Y which
requires a 25-foot P-L, Parking Landscaping, Zone9 along Cerritos Avenue, to develop
subf~ct property with an 8-foot wall artd a parking storage area which wi'llencroach
19 £eet into +-~^ •~ewired 25-foot P-L~ Zone..
2o Tha• the~e are exceptional or ex~raordinary circumstances or conditions applicabie
~to ihe proper±y invoived or to the intended use of the property that do not apply generally
to the property or class of use in the same vicinity and zone~
3o Zhat the requested va*iance is necessary for the preservation and enjoyment of a
sut~stantial.property right possessed by other property in the same vicinity and zone, and
denied to the property in questiono
4o That the requested variance will not be materialiy detrimental to the pubiic welfare
or injurious to the property or impro•rement:; in such vicinity and zone in which the property
is locatedo
5o That subject petition was initiated upon recommendation of the Administrative Office
and Planning Department in conjunction with the City's industrial development programo
6a That the shallow depth and irregt~;ar shape of the easterly porti,on of subject
prnperty create a hardship in the development of the property; that the only property
affected by the approval of this variance is the abutting property to the Fasty which has
a similar.site ~evelopment problemo ;~iexefore, no precedent is set by the approval of this
variance in the immediate areao

page 10 of Miscellaneous Maps, records of Orange County, California, described as

Comonencing at the Northwest corner of the Northeast quarter of the Southeast
quarter of said Section 23; thence South 89° 52' 49" East along a portion of the
Northerly line of the Northeast quarter of the Southeast quarter of said Section 23,
a distance of 112.00 feet to the true point of beginning of the parcel of land here-
inafter described, said point of beginning being the Northwest corner of that ~extain
parcel of land conveyed to the Sunshine Biscuits, Inc., a corporation, by deed recorded
July ?:, 1961 in Book 5779, page 966 of Official Records of Orange County, Califoaia;

the Northeast quarter of the Southeast quarter of said Section 23; thence North the SE~ of

, Petltion for Vadence, upon the following conditions which are hereby found to be a necessary prerequisit- to the pro-
posed use of the subject propecty in order to preserve the sefety and general welfare of the Citizena of the City of
~ Aaaheim.
lo I'hat the owner of subject property shall deed to the C1ty of Anaheim a strip of land
45 feet irt width, fram the center line of the streetv along Cerritos Avenue for stree;
widening purposeso
2~ That street improvement plans shall be prepared and all engineering requirements of
the City of Anahe;m a:cr.g Cer~itos Avenue; such as ~urbs and auttersa sidewralks, street grading5
and paving, dr.~inage faci'litiesy or other appurtenant work shall be completed as required by
the City Enginee•r and i.n accordance with standard plans and s ecifications on file~ in the off icE
of the City Enyineer; o•r tha~. a bond in an amount and form sa~isf actory to the City of Maheim
shall be posted with the City to guarantee the installation of said engineering requirementso
3o That the owner of sub3ect property sha11 pay to the City of Anaheim the sum of $2~00
per iront foot along Cerritos Avenue, for street lighting purposes~
4o That the owner of subject property shall pay to the City of Maheim the sum of '154
per f~ont foot along Cerritos Avenue9 for tree planting purposeso
5~ That Condit~on Nosa 29 2, 39 and 4y above mentioned shall be complied with prior to
the time that the Buiiding Perrtnt is issued or within a er~iod of 180 days from ckate hereof,
whici~ever occurs firsty or such further time as the Comm~ssion or City Council may grant~
6a That the variance shall not apply to the building setback but shall be limited to the
outdoor storage area only9 as indlcated on Exhibit Noo lo
7~ ?hat said 6-foct setback area shali be Iandscaped with screened plantinq from 3~ to
4~ feet in height and further that all parkway areas be landscaped to the satisfaction of
the Superintenden~ of Park,way ~laintenance prior to final building inspectfon~
