A RESOLUTION OF THE CITY PLANNING ODMMISSION OF THE CITY OF ANANEIM
THAT PETITZON POR CONDITIONAL USE PERMIT 701 BE GRANfED
WHEREAS, the City Planning Commission of ths City of Anaheim did receive a
ver.ified PetitiDn for Conditional Use Permit fro,n WIISHIRE OIL COMPANY, 666 East 17th
Street, Santa Ana9 California, Owner; H0INARD Ko LARSEN, 1022 West La Palma Avenue,
Anaheim,. California9 Agent, of certain real property situated in the City of Anaheim,
County of Orange, State of California, as described in Exhibit "A" attached hereto
and referred to herein as though set forth in full
;and
WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the
City of Anaheim on May 10, 1965y at 2s00 0.!ciock PoMo, notice of said public hearing
having bee~ duly given as required by law and in accordance with the provisions of the
Maheim :~unicipal code, Chapter 18,64, to hear and considor evidence for and against said
proposeid conditional use and to investigate and make findings and recormnendation~ '.~ connection~
tharewi.h; and
WHEREAS9 said•Commission, after due inspection, investigation9 and study made by
itself and in its behalf and after due consideration of all evidence and reports offered
at said heari.ng9 does find and determine the following factsa
1~ That the proposed use is properly one for which a Conditional Use Permit is
authorized by this Code, to wita estab.lish an existin; service station as a conforming
use and to establish an automotive service center with waiver of the required three-foot
wide screened planting strip adjacent to the right-of-ways height limitation within 15C
feet of R-0, Rasidential Suburban, Zoned p:opertyf and off-street parking requirements in
the C-1, General Commerical, Zoneo
2o That under the authority of Code Section 18<640070, waiver of Codes Section
18a40.070(2-a-3) which requires that 3 foot wide screen planting be maintained adjacent
to any right-of-way line; Section 18,400070(3-a) whict requires that the height of any
building or structure within•150 feet uf any single f anily rasidential zone shall not
exceed one-half the distance from said building or stru~ture to the zone boundary, and
Section 18o40a070(4-a-2-f) which requires that 5 spaces per one thousand square feet of
gross floor space shall be provided for parking.purposes is hereby granted to permit the
development of.the automotive center eliminating the requirES landscaped strips construction
of the building at a height of 28 feet; and providing 6 parking spaceso
3o That the proposed use will not adversely affect the adjoining land uses and the
growth and development of the area in which it is proposed to be locatedo
4. That the size and shape of the site propos~ed for the use is adequate to allow the
full development of the proposed use in a manner not detrimental to the particular area
nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheimo
5. That the granting of the Conditional Use Permit under th~ conditions imposed, if
any, will not be detrimental to the peace, health, safety and general welfare of the Citizens
of the City of M aheim.
6. That the granting of this petition shall not be considered as setting a precedent
for similar.development in other service station sites because sub3ect property has adequate
space and is separated from any residential uses by the flood control channel on the southo

lo That street improvement plans shall be prepared and all engineering requirements of
the City of Anahaim along West Street, such as crubs and gutters, sidewalksy street grading and
paving, drainage f acilities, or other appur~enant work shall be completed as *~qulred by the
City Engineer aad in accardance with standard plans z.~id specifications on file in the office
of the City Engineerj or that a bond in an amount and form satisfactory to the City of Maheim
shall be posted with the City to guarantee the installation of said engineering requirements~
2o That the owners of subject property shall pay to the City of Anaheim the sum of 15~
per front foot along La Palma Avenue and West Street, for tree planting purposes.
3~ That the owner6sof subject property shall pay to the City of Anaheim the sum of $2000
per front foot along La Palma Avenue and West Street, for street lighting purposes~
4o That trash storage areas shall be provided in accordance with approved plans on file
with the office of the Director of Public Works, prior to f inal building inspection.
5~ ?hat Condition Nos. 19 2,~~qd 3, above mentioaed, shall be complied with prior to the
time that the Building Permit is issued or within a period of 160 days from date hereof, which-
ever occurs f irsty or such f~~her time as the Commission or City Council may granto
6~ That subject property shall be developed substantially in accordance with plans and
specifications on file with the City of Anaheim9 marked Exhibit Noso 1 through 6~
