WEIEREAS, said Commission, after due inspection, tevestlgatlon, and aludy made bq itself ~nd in ib beh~lf,
and aftec due ooaeideration of all evideace and ~eports offerad n aUd heoring, does flnd ~nd deteemine the foIIowln~
facts:
1. That t6e petitioner reqne~h a vul~nce fiom the Aaaheim Muaicipal Code:~~ti3n'18.28.050( 6-b-] ) Nh~.ch
requires a 2I foot minimwo yard area for a building wall containing a mafn entrence (lOJr feet
proposed); Section 18.28>050(6-b-2) which requires a 17 foot minimimo yard area rrhere a build3ng
wall conteins windows opening i.nto a habitable room ~12 feet proposed); Section 18.28.090(9-b)
which requir.es that the maximwn distance of livinq unite to a dedicated streeL shall be ~90
feet (279 feet proposed); Section 18,28>050(6-b-3) which requires that a minimum depth of 5
feet between the prop~orty line and accessory.building.be maintained (1 foot proposed); and
5ection 18,28.050(1-b) which requires that the minim~an build:r,g site width shall be 70 feet
(50 feet proposed) to develop sub~ect property.with 5 afngle story garden type apartments.
2e That there are no exceptional or extraordinary circumstances or conditions applicable
to the property involved.or to the intended use of the property thet do not apply generally to
the praperty or cYess of~use in the same vicinity and zone.
3e That the.requested bariance is not necessary for the.preservation and enjoyment of
a substantial property right poesessed by other'property in the sa~e vicinity and zone, and
denied to the property in questiono
4, That sub~ect property is developable for single family zesidential use.
5. That the requested varia~e will be materially detrimental to the public Nrelfare or
injurious to the property or improvemen~s in such vicinity and zone in which thE property
is located.
