i. Thet the p~oposed use is properly oae for which a Cond(tioaal Use Pa:mit is anthocised by thlo Code, to wit:
establish a walk-up rastauxant with waiver_.of Section.18.40.070(2-a4) which requires a 6-faot
masonry wall where.an.auta parking area abuts upon a local street where ~wo thirds of the
property in-the block.on the.opposite side of said local street is zoned for a single family
residential. use;_and'Section 18.40.070(2=a6) which requires a 10-foot land~caped setback
ad3acent to the=.yicaxk-~p restaurant, on subject property.
2..That the_proposed uae..~rill adversely affect the ad~oining land uses and the growth and
development of the area in which ft is proposed to be.located.
3. That the graating of the Conditional'Use Permit will be detrimental to the peace, health,
safetyn and ganeral welfare of the Citizens of the City of Mahe3m.
• 4:.That the proposed use.will be incompatible to the existing land uses already established
in.close prnximity to subject property.
5..That becauae.the proposed walk-up resi.aurant would be patronized by children at an~
. intersection which is heavily traveled by automohiles, the general welfare of the children

integrity of the local street.
7. That five pexsons appeared representfng 25 persons present, one af whom presented a
petition signed by 57 property owners, opposing sub~ect petition. -
