A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT NO.R91 BE DENIED

WHEREAS, the City Planning Commission of the City of Aneheim did receive e verified Petition for Conditional
Use Permitfrom LLOYD R. PETTENGILL, 1564 Tonia Lane, Anaheim, California, Owrer of certain real
property situated in the City of Anaheim, County of Orange, State of California, describEd in
Exhibit "A" a=tached hereto and referred to herein as though set forth in full
; and
WHEF.EAS, the City Planning Commission did hold e public hearing at the City Hall in the City of Aneheim on
October 10~ 1966, at 2:00 o'clock P.M., notice of seid public hearing having been duly given es required by
law and in accordence with the provisions of the Anaheim Municipal Code, Chapter 18.64, to hear and consider evidence
for and ageinst said proposed conditional use and to investigete end make findings end recommendations in connection
thecewith; and
WH£REAS, seid Commission, efter due inspection, invesZigation, end study made by itself end in its behelf,
and after due consideration of all evidence and reports offered et seid hearing, does find end determine the following fects:
1. That the ptoposed use is properly one for which a Conditional Use Permit i~ euthorized by this Code, to wit:
S ection 1R.b4.020(3-j-3) to permit the establishment of a walE:-up restaurant in the C-1, Zone.
2. That the oroposed use will adversely affect the adjoining land uses and the growth
and development o: the area in which it is proposed to be located.
3. That the proposed use will have a detrimental effect on the peace, health, safety, anc
yeneral welfare of the citizens of the City of Anaheim.
4. That the proposed use will be deleterious to the :esidential integrit}~ of the homes
established easterly of subject prooerty.
5. That ~raffic hazards would be created because of the location of a high school
entrance and exit gate directly across the street from subject property, and said area is not
now provided with a crosswalk or traffic lights to handle pedestrian traffic from the high
school.
6. That the oroposed access :rom the property onto Buena Vista Avenue would create an
undesirable traffic situation both at the intersection of Euclid Street and Buena Vista Street,
and cause an interruption of the residential traffic using Buena Vista Avenue. The proposed
arcess would also require the City's abandonment of the access rights to Buena Vista Street
which has been dedicated previousl.y.
7. That four persons appeared representing eleven persons present in the Council Chamber,
that two letters were received, one from the principal of the high school directiy across the
street and that a petition signed by 102 persons was receiveo, all in opposition to subject
petition.
