WHEREAS, the City Planning CommIssian of the City of Anaheim did receive a verified Petition for Veriance from
LLOYD R. PETTENGILL, 1564 Tonia Lane, Anaheim, California, Owner of certain real property
sit:ated in the City of Anaheim, County of Orange, State of California, described as Parcel 1:
the North 100.00 feet of the west 435.60 feet of the north 10 acres of the south 20 acres of the
southwest quarter of the northwest quarter of Section 21, Township 4 South. Range 10 West or the
San Bernardino Meridian. EXCEPT the East 1R2 feet thereof. Parcel 2: That portion of Lot 1 of
Tract No. 3303, as said lot is shown on a map of said tract recorded in book 110, pages 33 and
34 Miscellaneous hiaps, records of said Orange County, lying west of a line described as follows:
Beginning at a point on the Westerly prolongation of the most No:therly line of said Lot i
which is distant thereon South Rq~5R'00" West 1R2 feet from the IJorthwest corner of said lot,
and running thence South parallel witl, the center line of Euc.lid Avenue, as shown on said map
of Tract Noo 3303, a distance of 103.17 feet, more or less, to the Southerly line of ;aid Lot 1
; and
WHEREAS, the City Plenning Commission did hold e public hearing at the City Hell in the City of Anaheim on
October 109 1966~ et 2:00 o'clock P.M., notice of said public heari~~g having ueen duly given as required by
law and in acconfsnce with the provisions of the Aneheim Municipal Code, Chepter 18.68, to hear and consider evidence for
ectd against seid praposed variance and to investigete end make findings and recommendetions in connection therewith;
and
WHEREAS, seid Commission, efter due inspection, investigation, and study made by itself and in its behalE,
end efter due consideration of all evidence and reporfs offered at said hearing, does find and detertnine the following
Eects:
1. That the petitioner requests e varience from the Anaheim Municipal Code: to permit waivers of minimum
number of parking spaces required and maximum building height permitted, to establish a walk-
up restaurant, drive-in dairy and offices on subject property.
2o Th~at there are no excpetional or extraordir~ary circumsiances or conditions applicable
to the property involved or to the intended use of the property that dc not apply- generally
to the property or class of use in the same vicinity and zone.
3. That the requested variance is not necessary for the preservation ar.d enjoyment of a
substantial property right possessed by other property in the same vicinity and zone, and
denied to the property in question.
4, That the requested variance will be materially detrimental to the public tia~elfare
or injurious to the property or improvements in such vicinity arid zone in which the property
is located~
5, That four persons appeared representing eleven persons present in the Council
Chamber; ttiat two letters; one from the principa~ of a high school located direcily acro~s
tfie street; and that a petition signed by ]02 persons, all were rece'_ved in opposition to
subject oetition~

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby deny subject
Petition for Variance on the besi~ of the aforementioned findings.
THE FOREGOING RESOLUTION is signed end approved by me this 20th day of October~ 1966.
