A RESOLUTION OF THE CI7'Y PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIAPICE N0. 1R25 gE DENIED
WHEREAS, the City Planning C.nmission of the City of Anaheim did receive a verified Petition for Verience from
ALBERT KEVORKIAN, 11021 Heathcliff Street, Santa Ana, California, Owner; STANLEY J. SCHERER,
2043 Minerva Avenue, Anaheim,California, Agent of certain real property situated in the City of
Anaheim, County of Orange, State of California, described as beginning at a point in the
Easterly line of said Lot 11, 652.R feet South of the Northeast corner; thence Westerly parallel

lot to the Southerly line thereof; thence Easterly along said Southerly line to the Southeast

_' WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City of Aneheim on
~ October 10~ 1966, at 2:00 o'clock P,M., notice of seid public hearing heving been duly given es required by
lew end in accordance withthe provisions of the Anaheim Municipel Code, Chepter 18.68, to hear and consider evidence for
and against said proposed varience and to investigete and make findings and recommendations in connection therewith;
and
WHEREAS, said CommissSon, after due lnepection, investigation, end study made by itself and in its behalf,
and efter due consideretion of ell evidence and reports otfered at seid F.earing, does find end determine the fallowing
fects:
1. That the petitioner requests a varience from the Aneheim Municipel Code: to permi± the construction o`
a 29-unit two-story apartment developinent:
Section 1+~.2j~.050(°~-b) - Building and structural i~eight (one-story permitted
within 1`.%0 feet of a sina:e-`a~nily :esidantial zone;

Section 1R.2R.050(6-b-~) - Yard and buildiny setback, (13 feet required fron: east

2. That in order to provide for proper circulation for t!~e area in whic~: ti~e proposed
use is located, it is essential t!~at Julianna Street be extended across sub;ect property;
tiowever, even after the Commission recommended that revised plans incorporate exter.sion oi
said s~reet, the petitioner did not provide for sucn ex.tension.
3. That subject property is of adequate shape and size to be developed in accordance
witn the R-3 Code requirernents, and the requested waivers would be granting tne petitioner a
privilege not oranted other property in the generaJ area naving the sarr.e zoning.
4. That tne requested waiver o; ti~e one-story heiqht lirnitation withir 150 feet of R-1
developed property will be rnaterially detrimental to t'~e existiny sirigle far,~ily hornes ad;acent
to and in close proximity to subject propert;.
5. Tt~at the petitioner did not submit evidence of hardsi~ip proving that the requested
iariance was n~ ~ssary in accordance with requireme~ts of Section 1H.6'~.030.
