A RESOLUTION OF THE CITY PLANNLNG COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 1R09 HE DENIED
WHEREAS, the City Planning Commi~sion of the City of Anaheim did roceive a verified Petition for Verience from
~STEINY AND MITCHELL,INCORPORATED, 1401 North Baxter Street, Anaheim, California, Owners; BERT
GRIFFIN AND ARNOLD STANTON, 1407 North Baxter Street, Anaheim, California, Aqentsof certain real
prooerty situated in the City of Anaheim, County of Orange, State of California, described as
that portion of Lot 13 of Golden State Tract No. 2 as shown on a map recorded in Book 4, };jge 6R
- of Miscellaneous Maps, in the office of the County Recorder of ssid County, described as follows:

~ law end in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and conaider evidenr.e for
i and ageinst said proposed veriance and to investigete and meke findings and recommmdetions in connection thtrewith;

I WHEREAS, seid Commission, after due inspection, investigetion, and study mede by itself end in its behalf,
and nfter due consideration of ell evidence and reports offered at seid hearing, does find end determine the followin~
i facts:
1. That the petitioner requests a varience from the Aneheim Municipal Code to permit retdil sale5 in
the M-1 Li.ght Industrial, Zone on subject property.
2. That ~here are no exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use of the property that do not apply generally
to the property or class of use in the same vicinity and zone.
3o That the requested variance is not necessary for the preservation and enjoyment of
~ a substantial property right possessed by other property in the same vicinity and zone, and
~' denied to the property in question.
- 4. That the petitioner stipulated to removal of the existing sign advertising retail
- sales, and agreed to compl/ with all requirements of the M-1 Zone.
5o That a letter of opposition from one of the industries in close proximity was received.
