WHEREAS, the City Planning Commission of the City of Aneheim did receive a veri~ied Petition for Verience

Anaheim, California; HERBtRT NEWSOME, 2172 West Cerritos Avenue; and WILLIAM KROGSDALE,
2168 West Cerritos Avenue, Anaheim, California, Owners; JOSEPHINE CHANDLEE, P. 0. Box 3244,
Anaheim, Caliiornia, Agent of certain real property situated in the City of Anaheim, County
of Orange, State of California, d?scribed as Parcel 1- Lots 1 and 2 and the North 21.03 feet
of lot 3, all of Tract No. 2015, as per map recorded in book 58 page 16 of Miscellaneous Maps,
in the office of the county recorder of said county

by law and in accordance with the provisions of the Aneheim Municipal Code, Chepter 18.68,to hear end consider

1. Thet the petitioner request~ a variance from the An~heim Municipel Code: Section 18.40.070(3-a ) to
permit construction of a 12-foot hiyh structura (24-foot setback roquired - 20-foot setback
pr.oposed, adjacent to an R-1, On?-Family Residential, Zone property 1ine.
2. Thet there nre exceptionel or extreordinary circumstances or conditions appliceble to the property involved
or to the intended use of the property that do not apply generally to the property or cless of use in the same vicinity
end zone.
3. Thet the requested veriance is necessery for the preservation and enjoyment of a substantiel property right
posaessed by other propcrty in the seme vicinity end zone, end dmied ta the properEy in question.
4. That the requested veriance will not be materially detrimentel to the public welfare or injurious to the pmp~
eRy or improvements in such vicinity and zone in which the property is located,
5. That onA pArson appeared in opposition, submitting a petition signed by 30 property

NOW, THEREFORE, BE IT RESOLVED thet the Aneheim City Planning Commission does hereby gwnt subject
Petitlon for Veriance, upon thc following conditiona which ere hereby found to be a necessary prerequisite to the pro-
posed use of the subject property in order to preserve the sefety and general welfare of the Citizens of the City of
Anaheim.
1. That this Variance is granted subject to the completion of Reclassification
Noo 66-67-6.
2. That subject property shz11 be developed substantially in accordance ~Nith plans
and specifications on file with the City of Anaheim, marked Exhibit Nos. 1 and 2.
3. That any air-conditioning facilities proposed shall be properly shielded from
view from abutting streets, and the sound buffered from adjacent residential homes, prior
to final building and zoning inspections.
