A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THA'T PETITION FOR CONDITIONAL USE PERMIT NO.R70 BE DENIED
WHEREAS, the C3ty Planning Commission of the City of Aneheim did receive a verified Petition for Conditional
Use Permitfrom ARGUS IMJESTMENTS, 449 So~~th Beverly Drive, Beverly Hills, California, Owners;
LESTER MARShA.LL, 513 Las Riendas Lrive, Fullei~ton, California, Agent of certain real property
situated in the City of Anaheiro, County of Orange, State of California, described as Lots 56,
`. ,. 5R, 59, 60 and 61 of Tract No< 4643, as shcwn on a map thereof recorded in book 195,
poy^e5 35, 36 and 37, Miscellaneous Maps, records of sai Orange County
; and
WHEF.EAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on
August 15, 1966, et 2:OD o'clock P,M., notice of seid public hearing having been duly given as requited by
lew and in accordance with the provisions of the Maheim Municipel /.:od.:, Chapter 18.64, to hear and consider evidence
for and against said proposed conditional use and to investigate end make findings end recommendations in connection
therewith; and
WHERERS, seid Commission, efter due inspection, investigation, and study made by itself and in its behalf,
and after due consideration of all evidence end reports offered at sei~ heering, does find and detennine the following facts:
1. Thet the proposed use is properly one Eor which a Conditional Use Permit is euthorired by Code.
Section 1fl.40.060(c) establish a service station within 75 feet of a residential zone,
and at the intersection of a secondary and a local street.
2~ That the proposed use will adversely affect the adjoining :and uses and the growth
and development of the area in which it is proposed to be located.
3e That approval of the service station would generate comr~ercial traffic onto an
extremely long residential alley, which serves a~ the only access for the R-3 property to the
west and north of subject property,
4, That tfie proposed service stztion would have a deleterious effect on the residential
uses proposed to be esi:ablished in close proximity to subject property.
5. That three persons appeared, one representing a savings and loan association owning
a number of parcels, and a letter from the City of Orange was received, al~ in opposition to
subject petition~

NOW, THEREFORE, BF, IT RESOLVED that the Anaheim City Plenning Cammission does hereby deny subject
Petition for Conditional Use Permit on the besis of the aforementioned findings.
THE FOREGOING RESOLUTION is signed and epproved by me.this 25th day of August, 1966.
