WHEREAS, the City Plenning Commission did hold e public hearing et the City Hall in the City of Anaheim on
August 15~ 1966i et 2:00 o'clock P.M., notice of seid public hearing having been duly given as requited by
law and in acootdence tvith We ptovisions of the Maheim Municipal Code, Chepter 18,68, to hear and consider evidence for
and egainst said proposed variance and to investigete and meke findings end recommendations in connection therewith;
and
WHEREAS, said Commission, after due inspection, investigation, and study made by itself an~ in its behalf,
and after due co~sideration of all evidence and reports otfered at said hearing, does find and detecmine the following
facts:
1. That the petitioner requests e variance from the Aneheim Municipal Code: to permit corstruction of a
two story office building on subject prope.rty.
Section 18~38~050(3-a) - Heiqht of building w~thin 300 feei of an R-1 Zone limited
to one-half the distance from the building to ~he zone
boundary - 50 foot setback required for a 25 foot structure -
U foot setback proposed along the west property line.
2, That there are no exceptional er extrao~dinary circumstances or cor.diticnsa~licable to
the property invulved o•r to the intended use of the property that do not apply generaily to the
property or class of use in the same v;cinity and zone,
3, That the requested variance is not necessary for the preservation and enjoyment
of a substantial property ri9ht possessed by other property in the same vicinity and zone,
and denied to the property in question.
4. That the requested variance wi11 be materially detrimental to the public ~velfare
or injurious to the property or improvements in such vicinity and zone in which the property
is located~
5~ That the requested variance will be detrimental to the peace, health, and general
welfare of the adjoining singie family homeownerso
6. That three persons appeared, representing 10 persons present in the Council Chambery
opposing subject petitiona

NOW, THEREFORE, BE IT RESOLVED thet the Aneheim City Planning Commission does hereby deny subject
Petition for Variance on the besis of the aforementioned findings,
