WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition Eor Variance
from L. KENNETH AND 'cDITH F. HEULER AND G. BARTON AND MARGARET D. HEULER, 220 West Cypress
Street, Anaheim, California, Owners; CARL E. NELSON, 1000 West La Palma Avenue, Anaheim,
California, Agent of certain real property situated in the City of Anaheim, County of Orange,
State of California, described in Exhibit "A" attached hereto ar.d referred to herein as though
set forth in full

WHEREAS, the City Plenning Commission did hold e public hearing at the City Hall in the City of Aneheim
on July 6~ 1967, at 2:00 o'clock P.M., notice of seid public hearing having been duly given as required
by law and in accordence wi4h the provisions of the Anaheim Municipal Code, Chapter 18.68,to hear and consider
evidence for and egeinst seid proposed variance and to investigate end make findings and recommendetions in connec-
tion therewith; and
WHEREAS, said Commissinn, after due inspection, investigation, and study mede by itself end in its behalf,
and after due consideration of all evidence end reports offered at said heering, does find and determine the following
facts:
1. That the petitioner requests a variance from the Aneheim Municipel Code: to permit the constructior. oi a
6-story medical-office building on subject property as follows:
SECTION 18,38~050(4-a-3) - Minimum number of oarF:inq soaces (469 requireti; 242 proposedj.
SECTION 18,380050(3-a) - Maximum building heiqht within 300 feet of a R-A, Agricultural
Zone boundary (building height of 69 `eet proposed, r eouirina
a 138-foot setback :rom the R-A zone boundaries; a 47 foot
setback is propc,sed along the west property line).
2. That :here are exceptional or axtreocdinary circumstences or conditians appliceble to the property involved
or to the intended use of the property that do not apply generelly to the property or class of use in the seme vicinity
and zone.
3. That the requested variance is necessary for the preservation and enjoyment of a substantial property right
possessed by other property in the seme vicinity and zone, end denied to the property in question.
4. That the requested verience will not be meterielly detrimentel to the public welfere or injurious to the pmp-
erty or improvements in such vicinity and zone in which the property is loceted.
5. That the tuilding height-setback requirement is a technical waiver because tne R-A,
Agricultural, Zone property to the west is developed as a mortuary.
6. That the parking standards developed as a result of an extensive survey of an existing
comparable facility in the City of Orange indicate the proposed number of parking spaces is
adequate for the type of single purpose medical facility proposed.
7. That if future use of the proposed structure is for other than medical-of.`ice facilit-
ies, parkinq shall be provided in accordance tivith the parking requirements for the uses then
established.
fs. That 4 persons aopeared in opposition to the parking waiver, one oerson presenting a
petition signed by 62 persons also in opposition to the parkina waiver.

NOW, THEREFORE, BE IT RESOL~lED that the Aaaheim City Plenning Commission does hereby gtent subject
Petition Eor Ve~ience, upon the folloaving conditiona ahich are hereby found to be a necessary prerequIsite to (he pro-
posed use of the subjeM propetty ;n order to preserve the sefety and general welfere of the Citizens of the City of
Anaheim:
EngineerTand ineaccordance withlstandardaplansaandgspecificationsUOn fileeinlthe office oftthe
City Engineer.
2. That trash storage areas shall be provided in accordance with approved plans on file
with the office of the Director of Public Works.
3. That this variance is granted subject to the completion of Reclassification No.
66-67-75.
4. That Condit`_on Nos. 1 and 2, above mentioned, shall be complied with prior to final
building and zoning inspections.
5. That subject property shall be developed substantially in accordance with plans and
specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, and 3.
6. That this variance for the waiver of the parking requirements of the C-0 Zone shall
be applicable only so long as the property is used for medical-office facilities developed
substantially in accordance with plans on file herein.
