A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 1894 BE DENIED
WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition for Variance from
ANGELO ZABY, 1401 East 51st Street, Los Angeles, California, Owner; COX NEON ~RPORATION, Attn:
RON SOMMERFIELD, 1711 Bluff Road, Montebello, California, Agent of certain real property situated
in the City of Anaheim, County of Orange, State of California, described as the Northerly 265
*eet of the Westerly 460 feet of the Northwest quarter of the Northwest quarter of the Northeast
quarter of Section 27, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana,
as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orznge County.
Excepting therefrom the [Jorth 190 feet of the VJest 220 feet thereof.

WHEREAS, the City Planning Commission did hold a public hearing at the City Hell in the City of Anaheim on
July 6~ 1967~ at 2:00 o'clock P.M., notice of said public heering heving been duly given es required by
law and in accordance with the provisions of the Aneheim Municipal Code, Chapter 18.68, to hear and consider evidence for
and against said proposed variance and to investigete end make findings and recommendetions in connection therewith;
and
WHEREAS, said Commission, after due inspection, investigation, and study made by itself end in its behalf,
and efter due consideration of all evidence and reports offered at said hearing, does find and determine the following
facts:
1. Thet the petitioner requesta e variance from the Aneheim Municipal Code: to permit exoansion o: existing
sign:
SECTION 18,62.090(4-a) - Maximum ~ermitted sian area (350 square feet permitted; 648 square
feet proposed .
2. That there are no exceptional or extraordinary circumstanr,es or conditions applicable
to the propPrty involved or to the intended use of the property that do not apply generally to
the property or class of use in the same vicinity and zone.
3. That the requested variance is not necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and zone, and denied
to the property in question.
4. That the oetitioner did not prove a hardship existed to warrant consideration of the
sign waiver.
5. That at the time the existing sign was approved the petitioner was favored in the
interpretation of the sign area since a more literal interpretation would have required that
the two existing panels be consolidated.
6. That the existing sign is new in that it was approved under Buildiny Permit ilo. 1931 on
tiiarch 13, 1967, and the proposed additional sign copy could have been incorpor;ted into a free-
standing sign that conformed to the Sign Ordinance.
?. That the approval of a new non-conforming sign would grant a privileae to the property
in question rather than alleviate any hardship.
S. That the approval of a variance of this nature for approximately twice the sign area
permitted under this Sign Ordinance would promote similar requests for signing that VJOU~CJ not
conform to the Sign Ordinance.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plenning Commission does hereby deny subject
Petition for Variance on the basis of the aforementioned findings.
