A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 189~ BE DENIED

WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition for Varience from
JEROLD 0. AND EYVOPdNE L. BROWN, 1106 West South Streat, F.naheim, California 92802, Owners;
TARIQ M. SHAMMA, 914 East Kateila Avenue, Anaheim, California 92805, Agent of certain real
property situated in the City of Anaheim, County of Orange, State of California, described as
Lot No. 20 of Tract No. 1394
; and
WHEREAS, the City Planning ~^ommission did hold a public hearing et the City Hell in the City of Aneheim on
July 17~ 1967, at 2:00 o'clock P.M., notice of said public hearing having been duly given es required by
law end in accordance with the provisions of the Anaheim Municipal Code, Chepter 18.68, to hear and consider evidence for
and against seid proposxd variance and to investigate and make findings and recommendations in connection therewith;
end
WHEREAS, said Commission, after due inspection, investigation, end study made by itself and in its behalf,
and after due consideration of all evidence and reports oifered at said hearing, does find and detecmine the following
facts:
1. That the petitioner requests a variance from the Aneheim Municipal Code: to permit the establ ishment o:
office use of a residential structure:
SEGTION 18040.050(a) - Parkinq location and reauired :ront landscaoina
(Parking required to be in the rear yard, and
the front landscaping maintained; parl:ino is
proposed in the front yard).
SECTION 18.40.070(4-a-1-a) - Minimum reouired parnino soaces (8 spaces required;
7 spaces oroposed).
SECTION 18.40.070(2-a-5-a) - btaximum buildina heiqht. (2:1 setbac;: reGuireo
from a single family residential zor.e, or 18 :~et
required; 5 feet proposed for a prooosed addition
to the existing residential structu:e).
SECTIOt~ 18.40.070(2-a-4) - Reauired 6-foot masonrv wall (Code provides that
~n~hen two thirds of the property on the opposite
side of the street is zoned for single family

provided to the rear of ihe required planting to
screen any of the parl:ing areas on the C-1 property;
none is proposed).
2. That there are no exceptiona] or extraord3nary circumstances or conditions applicable
to the prop~rty involved or to the intended use of the property that do not aoply generally
to the property or class of use in the same vicinity and zone.
3. That r.he requested variance is not necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vi~inity and zone, and
denied to the property in question, since the requested variance would be granting a privileoe
i:o the petitioner not enjoyed by the adjoining property owners.
4. That tne requested variance petition, if granted, would establish an undesirable liviny
environment for residences, and might set a precedent for requests from other nearby property
owners, thereby destroying the residential integrity of the neighborhood.
5. That one person representing four persons present :n the Council Chamber appeared in
opposition to subject petition.

NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Planning Commission does hereby deny subject
Petition for Variance on the basis of the aforementioned findings.
THE FOF.EGOING RESOLUTION is signed and approved by me this 27th day of July, 1967.
