THAT PETITION FOR VARIANCE NO. 1896 gE APPROVED IN PART

WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from
CRAIG JEWETT, 1303 'Nest Valencia Drive. Fullerton, and IMPERIAL HOUSEHOLD SHIPPI;~G CAMPP.NY,
INCARPORATED, 2809 Columbia Street, Torrance, California, Owners; JOE L. LANE, 1335 West Valencia
Drive, Suite G. Fullerton, California, Agent of certain real property situated in the City o:
Anaheim, County of Orange, State of California, describeo as Portion :: Lot 16 0: Tract No. G703,
as per map recorded in book 169 oages 25 and 26 of Miscellaneous Maps, in the office o: t~e

WHEREAS, the City Planning Commission did hold a public hearing at the City Hell in the City of Anaheim on
July 31~ 1967~ at 2:00 o'clock P.M., notice of seid public hearing heving been duly givm as required by
law and in accordance with E~e provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for
and against seid proposed variance and to investigete end make findings end recommendations in connection therewlth;
and
l4HEREAS, said Commission, after due inspection, investigation, and study made by itself end in its behalf,
and efter due consideretion of ell evidence end reports offered at said hearing, does find and determine the following
facts:
1. That the petitioner requests a varience from the Aneheim Municipe! Code: to oermit the e=tablishment of
a billiard oarlor and pizza parlor havino on-sale beer o~ Portion ?]o. i, and to aPrmit a ozrcel
of land havin~ no frontage on a dedicated street on Portion No. 2.

2. That the proposed use of Portion ~do. 1 for a billiard parlor and pizza parlor wit~
on-saie beer woulo be incornpatible with the established industri~i and industrial related use=_
in this area, and could have a serious ef.°ect on the ultimate .ievelopment of the lots v:ithin
the industrial tract, and 'oased on these .`acts is hereby denied.
3. That the oroposed industrial use of Portion No. 2, via an easement for a~ce=_= over
Parcel ;~io. 1, is considered adequate, therefore, the lot split without frontaae on a dedicated
, street is granted, provided t;Zat the access easemant is aoproved by tha Engineering Division
. and Development Services Depzrtment.
4. That the requested variznce, as approved, will not be materially detrimental to the
public health or injurious to the prooerty or improvements in such vicinity and zone in which
the property is located.
5. That one person appeared in opposition, but at a subseauent meetir~ submitted a letter
witndrawing said opposition.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plenning Commission does hereby grant~subject
Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to fhe pro-
posed use of the subject property in order to preserve the safety and general welfere of the Citizens of the City of
Anaheim:
1. That a Parcel A4ap to record the approved division of subject property be submitted
to the City of Anaheim for approval and then be recorded in the office of the Orange County
Recorder.
?. That trash storage areas shall be provided in accordance with aporoved plans on file
with the office of the Director of Public Works.
3. That fire hydrants shail be installed as required and determined to be necessary by
the Chief of the Fire Department.
4. That the ovm er of Portion No. 1 shall submit to the City Attorney satisfactory
evidence of a recorded easement to provide perpetual ingress and egrees to Portion No~ ?_, prior
to the issuance of a building permit for any structure to be constructed on Portion "'o~ 2.
5. That the plans of development for Portion Dlo. 2 sha11 be submitted to the Plannina
Commission for approval of the access proposed througn and across Portion No. 1, prior to the
iseuance of a building permit for any str>>cture to be constructed on Portion i~;o. 2.
6. That adequate provisions shall be made to shield the drainage channel in the event the
westerly portion of the two parceis are used for oar~:ing purposes.
7. That Condition No. 1, abov~ mentioned, shall be complied with prior to tne time that tne
fiuilding Permit is issued or witnin a period of 180 days `rom date hereo.`, whichever occur=
first, or such further time as the Commission or City Council may grant.
