THAT PEI'ITION FOR VARIA;4CE N0. 1£i65 BE GRANTED
WHEREAS, the City Plannin9 Com~nission of the City of Anaheim did receive a verified
Petition for Variance from SAMUEL P.vD DOROTHY C. MAGID, 636 Ultimo Avenue, Long Beach, California,
90Fi14, Owners; HEATH AND COMPANY, 3225 Lacy Street, Los Angeles, California, 90031, Ager.t=_ of
certain real property situated in the City of Anaheim, County o: Orange, State of Cali:orn:a,
described as Lot 236 and 237 of Tract No. 2377, as oer inao recorded in book 75 oages 29 to 35
inclusive of Miscellaneous Maps, in the office of the county recorder of said county.

WHEREAS, the City Y!anning Commission did hold a public hearing at the City Hall in
the City of Anaheim on March 27, 1967, at 2:00 0'clock P.M., notice of said public hearino
having been duly 9iven as required by law a~d in accordance vrith the provisior.s of the Anaheir~
Municioal Code, Chapter 1R.6R, to hear and considez evidence :or and against said prooosed
variance and to investioate and make findings and recommendation=_ in connection therewith; and
WHEREAS, said Commis=ion, a:ter due inspection, investiqation, and study made by
itsel.f and in its behalf and after due cor.sideration of all evidence and reports offered at
said hearing, does find and determine the following facts:
lo That the petitioner requests a variance from the Anaheim hlunicioal Code: to permit
the erection of a free-standing sign with waivers of:
SECTIOiJ 1R.62 090(B-1) - A7aximum number of siqns. (1 free-standin~ or roof sign
per parcel permitted; one new free-stznding sign in
addition to 5 existina iree-standina sians and severzl
existinca roof signs proposed).
SECTIG'J lA.o2.090(B-1) - Minimum distance oetsveen free-standing signs. (300 ieet
required between frze-standing signs on same parcel; nev:
sign proposed 150 .`eet irom one e~cisting free-standing
sign and 1~5 :°eet from a second existing free-standing
siqn; two roof siqns also located within 300 feet of the
proposed sign).
2. That there ar2 exceptional or extraordinary circumstan~es or conditions app:icable to
the property involved or to the intended use o` the property tnat do not apply aenerally to the
oroperty or class of use in the same vicinity and ~one.
3. That the requested variance is necessary for the preservation and enjoyment o.` a
substar,:ial property right possessed by other property in the same vicinity and zone, and denied
to the property in question.
4. That tne requested variance wil] not be materially detrimental to the public tvelfare
or injurious to the prooerty or improvements in such vicinity and zone in lvhich the oropert}~
is located.
5. That no one aopeared in opoosition to subject petition.

NOW, THEREFORE, BE IT RESOLVED that the An~heim City Plenning Commission does hereby grant subject
- Petition fot Variance, upon the following conditions which ate hereby found to be a necessary prerequisite to the pro-
posed use of the aubject property in order to preserve the safety and generel welfare of the Citizens of the City of
Anaheim.
1. That subject property shall be developed substantially in accordance with plans
and specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, and 3.
