A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 1873 BE APPROVED IN PART

WHEREAS, the City Planning Commission of the City of Anaheim did receive e verified Petition for Verience from
FRANK SACKETT, % CARL COWLESs 106 West 4th Street, Santa Ana, California, Owner; CHARLES SCHLEGc]
433 West 8th Street, 5anta Ana, California, Agent of certain real property situated in the
Cjty or Anaheim, County of Orange, State of California, described in Exhibit "A" attached
hereto and referred to herein as though set forth in full

WHEREAS, the City Planning Commission did hold a public hearing et the City Hall in the Ci:y o£ Aneheim on
May 8~ 1967~ et 2:00 o'clock P.M., notice of seid public hearing heving been duly given as required by
law and in acoordance with the provisions of the Anaheim Municipel Code, Chapter 18.68, to heer end consider evidence for
and against seid proposed veriance and to investigate and make findings and recommendations in connection therewith;
and
WHEREAS, said Commission, efter due inspection, investigetian, end study made by itself and in its behalf,
and efter due consideretiort of ell evidence and reports offered 'at said hearing, does find end determine the following
fects:
1. Thet the petitioner requests e variance from the Anaheim Municipel Code to permit a 42-foot high~
450-square foot sign with waivers of:
SECTIOIJ 18.62~090(B-1) - Maximum number of free-standino signs, (300-feet re-
quired between .`ree-standing signs; 15~ and 173-feet
proposed).
SECTION lt3,o2-090(B-2) - Maximum oermitted sign heioht (25-feet permitted within
300-feet of single family residential zone; 42-;?et
proposed)~
SECTIOfJ 18~62~090 B-4 - Maximum permitted sign area (350-square ieet oermitted;
451-square feet proposed)~
2~ That tne petitioner ~as not proven a hardsnip v~ould exist i` tne maximum perTitted
sign area was not grar.ted; therefore, waiver oi Section 12.52~090(B-4) is hereby
denied, and development must ce v,~ithin the sign area standards of the Sign Urdinance~
3. That beco~~e of the existence of the previously app-oved free-standinq signs on sub-
ject property, some hardship would exist; therefore, the °ianning Commiss;on grants a
height o` 30-feet for ihe proposed sign, provided ihat lighting oi the sign will be in
ti~e ofr nosition when facing toward the multiple family area to the north and easto
4~ Tha' there are some exceptional or extraordinary circumstances or conditions appli-
cable to tFe intended use of tne property, as appro••ied by this act=on, that do not
apply generally to the property or class of use in the same vicinity and zone.
5o That the requested variance, as approved, is necessary for the preservation ar.d ?n-
joyment of a substantial oroperty right oossessed by other property in the same vicin-
ity and zone, and denied to the property in question~
6o That the requested variance, as aoproved, will not be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone
in which the property is located„

NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Plenning Commission does hereby grant~ubject
Petition For Verience, upon the following conditions which are hereby found to be a necessary prerequisite to the pro-
• posed use of the subject pcopedy in order to preserve the saEety and general welfare of the Citizens of the City of
Anaheim.
1, That subject property shall be developed substantially in accordance with plans and
specifications on file with the City of Anaheim, marked Exhibit Nos. 1 and 2, prov~ded
howevex, that the maximum height shall be 30-feet, the maximum width shall be 16-feet
plus or minus, and the maximum size shall be 350-square feet, as depicted on Exhibit "B";
and further provided, that the rotating portion of the sign shall be in an off position
_ when viewed from the northeast quadrant, as depicted on Exhibit "B-1".
THE FOREGOING RESOLUTION is signed and approved by me this 18th da'~ of May, 196'.
