PC68•-103 ;s, \ ,~ 1 I i ` I °'-~ "~ h I A RESOLUTION UF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 196o BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from BERNARD A. AND EMMA G. 5TOFFEL, ].19 North Helena, Anaheimy Caiifornia 92805, Owners; LF.E 0. WE~B, 1008 South Anaheim Boulevard, Anaheim, California 92805, Agent of certain real property situated in the City of Anaheim, Count~~ of Orange, State of California, described in Exhibit "P." attached hereto and referred to herein as though set forth in full. i ; and WHEREAS, the City Planning Commission did hold a public hearing at the City }(all in the City ot Anaheim on April 8, 1968, at 7:00 o'clock P.M., notice of said public heating having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chaptvr 18.68, to hear and consider evidence for and egainst said proposed variance and to investigate and make findings ,nd recommendations in connec- tian therewith; and 1VHEREAS, said Commissinn, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the propecty or class of use in the same vicinity and zone. 3. That the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 4. That the requested variance will not be materially detrimental to the public welfate or injurious to the prop- erty or improvements in such vicinity and zone in which the property is located. 5. That a Parcel Map to record the approved division of subject property be submitted to the City of Anaheim for approval and then be recorded in the office of the Orange ~ounty Recorder. 2. ?hat the owners of subject property shall deed to the City of Anaheim a ten (10) font overhang easement, the center of which is the easterly property line of the subject property. 3. That the owners of subject property shall deed to the City of Anaheim a 5-foot by 5- foot public utility easement along the southerly property line the centerline of which is the easterly property line of subject property. 4. That any air-conditioning facilities proposed sha11 be properly shielded from view and the sound shall be buffered from adjacent residential homes. 5. That all exterior lighting shall be directed downward and away from abutting property lines. 6. That Condition Nos. 1, 2, and 3, above mentionecl, shall be complied with prior to the time that the Building Permit is issued or within a period of 180 days from date hereof, which- ever occurs first, or such further time as the Commission or City Council may grant. 7. That Condition Nos. 4 and 5, above mentioned, sha11 be comolied with prior to final building and zoning inspections. 8. That subject property shall be developed substantially ir accordance with plans and specifications on file with the City o.` Anaheim, marked Exhibit D]o. 1.
