A RE50LUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 1965 gE APPROVED IN PART
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from
ALAN R. AND MARJORIE J„ TALT, WILSHIRE FLOWER BUILDING, 615 South Flower Street, Suite 806, Los
Angeles, California 90017, OWners; ROBERT S. MC MICHAEL, 469 "A" West Valencia Drive, Fullerton,
California 92632, Agent of cer.tain real property situated in the City of Anaheim, County of
Orange, State of C;lifornia, described in Exhibit "A" attached hereto and referred to herein as
though set forth in full

, 1 WHEREAS, the City Planning Commission did hold a public her~ring at !he City Hall in the City of Anaheim on
I~ ;; April 8~ 1968~ at 7.00 o'clock P,M., notice of said public hearing heving been duly given as required by
18w and in acmrdance with the provisions of the Anaheim Municipal Code, Chepter 18.68, to hear and consider evidence for
„ and against said proposed variance and to investigate and make findings and recommendations in connection therewith;

WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf,
and after due consideration of all evidence and reports offered at said hearing, does find and determine the following
facts;
1. That the petitioner requests a variance from the Anaheim Municipal Code as follows, in order to develop
Portion "A" with a 112-unit multiple family residential development on subject property, v~ith
~vaivers of:
SECTION 18.28 050(5-b) -• Buildina and structura: heicaht limitations (The maximum ~eiat
of any structure within 150 feet of any sinqle-family

2• 7hat waiver of the yard and building setback requirements znd the minimum distances
between buildings is hereby denied on the basis that the petitioner was not certain he would
develop in accordance with the olans before the Commission.
3. That the waiver of the buildinq and structural height limitations is deemed necessary
based on the fact that the single family residential zone ad;ac;~~ t;, st;~j~r~ pr~p~•r~y is tha
R-A Zone, which has been considered a holdina zone until such time as development ta~es olace,
and since the General Flan Amer.dment aoproved does not project the zdjoininy properties for
development with single family homes the ivaiver is a technicality.

NOW, THEREFORE, BE IT RESOLVED thet the Ansheim City Plenning Commission does hereb in part
Petition for Verience, upon the followIng conditiono whlch are hereby found to be a necessary prerequ sigeeto/fhe prot
posed use of the subject property In ordet to proserve the safety end general welfare of the Citizens of the City of
Anaheim:
Portion "A" onlv:
l. That this variance is granted subject to the completion of Reclassification No. 67-68-7'v
2. That trash stora9e areas shall be provided in accordance with approved plans on file
with the office of the Director of Public Works.
3. That fire hydrants shall be instal.led as required and determined to be necessary by
the Chief of the Fire Department.
4. That Condition Nos. 2 and 3, above mentioned, shall be complied with prior to final
building and zoninq inspections.
5. That subject property shall be developed substantially in ar.co*dance witl~ pians and
specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, and 3.
