IVHEREAS, the City Planning Commission of the City of Rnaheim did receive a verified Petition for Conditional
Use Permit from Hr"R~ PROPERTIES, IIJCORPORATED, 1505 East 17th Street, Suite i~7, Santa Ana,
California 92701, Owner of certain real property situated in the City of Anaheim, County of
Orange, State of California, described as that portion of Lot 4 of Anaheim Extension, as shown
on a Map of Survey by.William Hamel, a copy of which is shown ~n book 3, pages 162 to 164, in-
clusive, of Los Angeles County Naps, in the office of the County Recorder of Oranoe County.
Beginning at the point of intersection of the Easterly line of East Street, 66.OOJfeet wide, with
a line that is parallei with and distant Northerly 480.00 fee~ from the centerline of Center
Street, as said centerline is shoivn on a Map filed in book 28 page 22 of Record of Surveys;
thence North 74°37'25" East parallei with said centerline of ~enter Street 150.00 feet; th~ence
South 15°~4'15" East parallel with said Easterly line of East Street 305.00 feet to a point in
a line that is parallel with and distant tJortherly 175.00 feet from s=id centerline of Center
Street; thence South 74~37'25" West parallel with said centerline 150.00 feet to a point in
said Easterly line of East Street; thence North 15°24'15" West along said c"asterly line of East
Street 305.00 feet to the point of beginning. rJCCEPT the Southerly 190 feet thereof.

K'HEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on
April 22, 1968~ at 2:00 o'clock P.M., notice of said public hearing heving been duly given as required by
law and in accordance with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear and consider evidence
for and agair.st said proposed conditional use and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspectian, investigation, and study made by itself and in its behalf, and
after due consideration of all evidence and reperts offered at said hearing, does find and detertnine the following facts:
1. That the proposed use is properly one for which a Conditional Use Pertnit is authorized by Code Section
;8.40.060(e) to wit: establish a walk-up restaurant on subject property.
2. That the proposed use will not adversely affect the adjoining land uses and the growth and development of
the area in which it is proposed to be located.
3. That the size and shape of the site proposed for the use is adequate to allow the full development of the
proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of
the Citizens of the City of Anaheim.
4. That the granting of the Conditional Use Pecmit under the conditions imposed, if any, will not be detrimental
to the peace, health, saEetv, and general welEare of the Citizens of ihe City of Anaheim.
5. That the petitioner stipulated to revising the parkin9 layout to provide more
efficient on-site circulation facilities which shall be approved by the Development Sarvices
Deoartment.

NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Planning Commission does hereby grant subject
Petition for Conditional Use Permit, upon the following conditions which ere hereby found to be a necessary prerequisite
to the proposed use of the subject property in order to presetve the sefety and general welfere ofthe Citizens oEthe
City of Anaheim:
1. That the owner of subject property shal~ deed to the City of Anaheim a strip of land
40 feet in width from the centerline oF the street along ~ast Street, for street widening
purposes.
2. That street improvement plans shall be prepared and all engineering requirements of
the City of Anaheim along East Street, such as curbs, and outters, sidewalks, street grading and
paving, drainage facilities, or other appurtenant work shall be completed as required by the City
Engineer and in accordance with standard plans and specifications on fiie in the office of the
City Engir.eer; and that a bond in an amount and fcrm satisfactory to the City of Ar,aheim shall be
posted with the City to guarantee the installation of said engineerin~ requirements.
3. That the owner of subject property shall pay to the City o~ Anaheim the ~um of $2.00
per front foot along East Street, for street lighting purposes.
4. That the owner of subject property shall pay to the City of Anaheim the surr. of 15

6. That trash storage areas shall be orovided in accordance with approved plar.s on file
with the office of the Director o. Public Works.
7. That any air-conditioning :acilities proposed shall be properly shielded :rom vieim,
and the sound shall be buffered from adjacent re=idential homes.
8. That all external lighting shall be directed downward and away from abutting property
` lines.
j 9. That Condition Nos. 1, 2, 3, G, and 5, above mentioned, shall be compiied with prior
to the time that the Building Permit is issued or within a period of 180 days :rom date hereo:,
whichever occurs :irst, or such .urther time as the Commission or City Council may grant.
10. That Condition ~?os. 6, 7, and 8, above mentioned, shall be complied with prior to;ina]
building and -oning insoections.
11. That subject property shall be developed substantially in accordance wit^ olans and
specifications on file ~,vith the City of Anahaim, mzrked Exhibit Nos. 1 and 2, orovioed, however,
that the parking layout shall be revised and approved by the Development Services D~partment.
