A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. i976 BE GRANTED

WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance
from BARRY AND SANDRA REYNOLDS, 613 South Agate S~reet, AnaheimY Caliiornia 92804, Owners of
certain real property situated in the City of Anaheim~ County of Orange, State of California,
described as Lot No. 7 of Tract No. 3347
; and
WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim
on May 6, 1958~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required
by law and in eccordance with the provisions oE the Anaheim Municipal Code, Chapter 18.68,to hear and consider
evidence for and against said proposed variance and to investigate and make findings and recommendations in connec-
tion therewith; and

WHEREAS, said Commissinn, after due inspection, investigation, and study made by itself and in its behalf,
and after due consideration of all evidence and reports offered at said hearing, does find and determine the following
facts:
1. That the petitioner requests a variance from the Anaheim Municipal Code as follows, to oermit the
establishment of an existing room addition as a conforming use:
SECTION 18.24.030(2) - Minimum_reauired side vard (5 feet required; 0 feet existing
and proposed).
2. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved
or to the intended use of the property that do not app]y generally to the property or class of use in the same vicinity
and zone.
3. That the requested varience is necessary for the preservation and enjoyment of a substantial property right
possessed by other property in the same vicinity and zone, and denied to the property in question.
~ 4. That the requested variance will not be materially detrimentel to the public welfare or injurious to the prop-
erty or improvements in such vicinity and zone in which the property is located.
5. That the City-own~ well site to the north o: subject property is not a ouildable
. parcel and i: the well were ±o be abandoned, the owners of subject property would probably
have first opportunity to acquire the parcel, in which case the side yard setoacF: for the
existing recreation room would be 20 feet.
