A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 1973 gg APPROViED IN PART
WHEREAS, the City Planning Commission of ti~e City of Anaheim did receive a verified Petition for Variance from
CALII~RNIA FEDERAL SAVINGS AND LOAN ASSOCIAiION, 5670 Wilshire Boulevard, Los Angeles, California
90036, Owner; COVINGTON BROTHERS ~NSTRUCTION COMPAI4Y, 2451 East Orangethorpe, Fullerton,
California 92631, Agent of certain reai oroperty situated in the City of Anaheim, County of Orange,
State of California, described in Exhibit "„" attached hereto and referred to herein as though set
forth in full
; and
WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on
May 6~ 1968~ at 2:00 o'clock P.h1., notice of said public hearing having been duly given as required by
law and in ecrnrdance with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for
and against said proposed variance and to investigate and make findings and recommendations in connection therewith;
and
1VHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf,
and after due consideration of all evidence and reports offered at said hearing, does find and determine the following
facts:
1. That the petitioner requests a variance from the Anaheim Municipal Code as ~ ollows~ in ordP.r to establish
192-unit apartment complex on subject property:

along the west boundary of Lot 3 and the east boundary of
Lot 4; 12.5 feet proposed),

SEGTION 18.28 050(10-a) - Minimum reouired number and tvoe of oarkino soaces.(50
covered spaces required on the two parcels fronting on
Lincoln Avenue where the efficiency units are prooosed;
petitioner proposes only 40 spaces on each lot, 12 of which
would be covered, the remaining 28 spaces would be un-
covered or oper, parking soaces).
SECTION 18.28 050(10-b) - Maximum distance between reauired ~arkina soaces and the
units which thev are to serve. (A maximum of ?_00 feet
permitted; 208 feet proposed :or 10 uni.ts on Lots 3 and 4),
2. That the reouest for v~aiver of the buiiding site area oer dwelling unit, and minimum
floor area per dwelling unit to permit development of singie (bachelor) apartmeni units on the
two parcels fronting on Lincoln Avenue are hereby denied on the basis that a residential develop-
ment with a density of 55 units per net acre would create an undesirable precedent for similar
requests where medium density (permitting a maximum of 36 dwelling units per net acre) is deemed
appropriate, thereby creating a burden on the public facilities such as sewer, water, and
streets which have not been provided for.
3. That the requested waiver of the 35-foot setback required by City Counci.l policy along
Lincoln Avenue is hereoy denied on the basis that other properties which have developed along
Lincoln Avenue have complied with the required setbach, and to ~rant subject property this
waiver would be granting a privilege not enjoyed by other property ovm ers along Lincoln Avenue.

4. That the requested waiver of the minimum required number and type of parking spaces
is hereby denied on the basis that studi~s made have proven that the required parking by Code
is necessary in order that adequate off-street parking is provided for visitors as well as
covered resident parking.
5. I'hat the requested variance as approved, will not be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone in
which the property is lacated.
6. That one person appeared representing four persons present in the Council Chamber in
opposition to the propos2d bachelor apartment units and any circulation which would come
from subject property thru the single family subdivision to the north.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby
~T grant in part subject Petition for Variance, upon the rollowing conditions which a~•e hereby
.ound to be a necessary prerequisite to the proposed use of the subject property in or~er
to preserve the safety and general welfare o: the Citizens of the City of Anaheim.
1. That this variance is granted subject to the completion of Reclassification hlo.
67-68-79.
2. ';hat trash storage areas shall be provided in accordance !~~ith approved plans on file
with the o`:ice of the Director of Public Works.
3. That fire hydrants shall be installed as required and determined to be necessary by
the Chie` of the Fire Department.
' 4. That Condition Nos. 2 and 3, above mentioned, shall be complied with prior to final
building and zoninq inspections.
5. That subject property shall be developed substantially in accordznce w~th plans and
specifications on file with the City of ~naheim, marF:ed Exhibit iJos. 1, ~, and 3, as it per-
tains to the northerly 384.66 feet.
