WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from
FR~DRICKS DEVELOPMENT CORPORATION, 524 West Commonwealth, Fullerton, California 92632, Owner;
MANNY'S RESTAURANTS, ATTENTION: LARRY SOUZA, ll13 West Struck Avenue, Oranqe, California 92667,

quarter of Section i, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa
Ana, as shown on a map thereof recorded in book 51, page 10, Miscellaneous Maps, r ecords of said
Orange County. EXCEPTING THEREFROh1 the Southerly 200 feet of the Westerly 200 feet thereof.

WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Aneheim on
Jun e 3~ 1968~ at 2:00 o'clock P.M., notice of said public hearing having been duly gi ven as required by
law and in acmrdance with the provisions of the Anaheim Municipa] Code, Chepter 18.68, to hear and consider evidence for
and against said proposed variance and to investigate and make findings and recommendations in connection therewith;
and
WHEREAS, said Commission, aiter due inspection, investigation, and study made by itself and in its behalf,
and after due consideration of all evidence and reports offered at said hearing, does find and detennine the following
fncts;
1. Thet the petitioner requests a variance from the Anaheim Municipal Code as follows, to replace an
existing free-standing sign with a taller sign.
SECTION 18.62 Oo0(B-2) - Maximum heiqht of a free-standinq sian. (A maximum o; 25
f eet permitted when within 300 feet of a resident~al ~~~A~

2. That there are no exceptional or extraordinary circumstances or conditions aoplicab?e
to the property involved or to the intended use of the psoperty that do not apply generally
to the property or class of use in the same vicinity and zone.
3. Tha~ the requested variance is not necessary for the oreservation and enjoyment of a
substantial property right oossessed by other property in the same vicinity and zone, and
denied to the property in question.
4. That the requested ~•ariance will be materially detrimental to the oublic welfare or
injurious to the property or improvements in such vicinity and zone in which the property is
located.
5. That the petitioner has not proven a hardship exists, and to approve subject o2tition
would be granting the petitioner a privilege not enjoyed by other prooerties in the area,
namely the identif~cation sign of the shopping center, and the hamburger stand immediately to
the north.

NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Planning Commission does hereby deny subject
Petition for Variance on the basis of the aforementioned findings.
THE FOREGOING RESOLUTION is signed and approved by me this 13th day of June, 1968.
