A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM =
THAT PETITION FOR VARIANCE N0. 1995 Hg APPROVED
WHEREAS, the City Plonning Commission of the City of Aneheim did receive a verified Petition for Variance from
CLARK W. WINGERT~ ET AL, 125 South Rio Vista Street, Anaheim, California 92806, OJmer; J. W. KLUG
DEVELOPMFNT COMPP";Y, INCORPORATED, 4540 Campus Drive, Newport Beach, California 92660, Hgent of
certain real property situated in the City of Anaheim, County of Orange, State of California,
described in Exhibit "A" attached hereto and referred to herein as though set forth in full
; end
WHEREAS, the City P(anning Commission did hold a public heering at the City Hall in the City of Anaheim on
July 1~ 1968~ at ~:00 o'clock P.M., notice of said public hearing heving been duly givm as required by
law and in ecoordeace with the provisions of the Anaheim Municipal Code, Chepter 18.68, to hear and consider evidence,for
and against said proposed veriance and to investigete end make finding's end tecommendetions in connection therewith;
and
WHEREAS, said Commission, after due inspection, investigation, end study made by itself and in its behalf,
and efter due consideration of all evidence end reports offered at seid heering, does find and determine the following
facts:
1. 'I'hat the petitioner requests a variance from the Anaheim Municipal Code as foliows~ to permit develop-
ment of some of the 107 R-1 lots viith less than minimum requirements.
SECTION 18.24.030(4-a) - Minimum lot width. (70 feet required; minimum of 60-feet
proposed).
SECTION 18024.030(4-a) - Minimum lot area. (A minimum of 7200 sauare feet required;
5700 square feet r~inimum proposed).
SECfION 18.800090 - Minimum floor area per dweilinq unit. (1525 square feet
required; 1460 square feet proposed).
SECTION 18024.030 - Minimum re uired front vard. (25 feet required; 20 feet
minimum proposed .
2. That waiver of the minimum 70-foot lot width is hereby denied for those lots along
the north boundary of subject property; however, 65-foot lot widths will be permitted; and that
the balance of the lots may be developed with 60-foot widths on the basis that the parcel is
difficult to develop due to the freeway off-ramp projecting diagonally across the lower portion
of subject property.
3. That waiver of the minimum floor area per dwelling unit to permit 1460 square foot
dwellings, is hereby granted for 25% of the lots only.
4. That waiver of the minimum 7200 square foot lot area is granted to permit variable
lot sizes, however, the lots along the north boundary of subject property shall be a minimum
of 6500 square feet, with no lot in the subject tract to be less than 5500 square f eet in area.
5. That there are exceptionai or extraordinary circumstances or conditions applicabie to
the property involved or to the intended use of the property that do not apply generally to
the property or class or use in the same vicinity and zone.
6. That the requested variance is nec=ssary for the preservation and enjoyment of a sub-
stantial property right possessed by other property irt the same vicinity and zone, and denied
to the property in o,uestion. ~~
7. That the requested variance will not be materially detrimental to the public welfare
or injurious to the property or improvements in such vicinity and zone in which the property
is located.
8. That one person app eared in favor of subject petition.
