4 ,: A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
~ ~ THAT PETiTION FOR CONDITIONAL USE PERMIT Nb. 1054 BE GRANTED
WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition for Conditional
Use Pennitfrom E. F. DARGATZ AND.WOODY JOHNSON, 224 West 5th Street, San~ta Ana, California,
Oyi~ners of certain real property situated.in the City of Anaheim, County of Orange, State of
~"" y, Calif.ornia, described as Lot l of Tract No. 3886, as_shown.on a map recorded in book 151, pages
x, .='! B, 9 and 10, Miscellaneous Maps, records of Orange County.. EXCEPT THEREFROM the Westerly
~ 130.00 feet of the Northerly 120.00 feet, said 130.00 feet and 120.00 feet being measured from
the tangent portions of the westerly and Northerly lines, respectively, of said Lot i.

WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Aneheim on
August 12, 1968, at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by
law and in eccordence with the provisions of the Anaheim Municipal code, Ch.epter 18.64, to hear and consider evidence
for end agair.st said proposed conditional use and to investigate and make findings and cecommendetions in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation, end study made by itself and in its behalf, and
after due wnsideration of all evidence and reports offered at said hearing, does find and determine the following facts:
1. That the proposed use is properly one for which.-a Conditional Use Pertnit is euthorized by Code~ '
Section 18.40.060(g), to wit: permit on-sale liquor in a proposed cocktail lounge and
restaurant.on subject property.
2. That the proposed use will not adversely affect the adjoining land uses and the growth and development of
the area in which it is proposed to be located.
3. Thet the size and shape of the site proposed for the use is adequate to allow the full deyelopment of the
proposed use in a manner not dettimentel to the particuler area nor to the peace, health, safety, and general welfare of
. the Citizens of the City of Anaheim.
4. Thet the grenting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental
to the peace, health, safety, and general welfare of the Citizens of the City of Maheim.
5. That the Centralia.School District in a telephone message re~terated their opposition
to on-sale liquor across the street from the school. '
6. That the proposed operator of.the resteurant stipulated to providina 25% of the
gross floor area for food preperation.
7.,;That the.plans presented by'the petitioner indicated that the proposed cocktail
. Tounge would be e int~egral part of the overall restaurant operation.
8. Thet a petition signed by 37 persons in favor of subject petition was received.

2..Thar: any. air-conditioning facilities.proposed shall be properly shielded from view, 3

3. That Condition Nos. 1 and 2, above mentioned, shall be complied with prior to final
building and.zoning inspections. • ~
