That the petitioner requests a variance from the Aneheim Municipal Code as follows to oermit subdivision of property with &0 R-2-5000 Zoned lots: SECTION 1~~.96.050(3) - MaximLr: oer,~;i~ted coveraaa (-:~% permitted; 5Ct,o prooosed). SECfIOi! 1R,26.050(5-b) - Atinimum reouired sicle vard (5 feet required; petitioner proposes to develop each lot with no side yard along one side of the lot but providing a distance o: 10 feet between buildings, thereby creating a 10 foot side yard along the opNosite side of each structure). SEGTIOiJ 1$.04.09G(2-h-2 - Maximum heioht of f ences in reauired vards (A maximum of and 4) 6 feet permitted in the side and rear yards, and a maximum of 42 inches permitted in the front yard; petitioner proposes to develop privacy fences not to exceed 8 feet in height along all property lines or within the front, side, or rear yards). 2. That the requested waiver of maxinum lot coverage is hereby denied on the basis that adequate recreation-leisure area will not be available for residents oi these smaller sized lots. ?. That there ai•e exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intsnded use of the property that do not apply generally to the property or class o,` use in the same vicinity and zone. 4. That the requested variance is n=cessary for the preservation and enjoyment of a substantial property right possessed by other oroperty in the same vicinity and zone, and denied to the property in question. 5. That this variance is granted subject to the completion of Reclassification No. 67-68-A7, 2.
