A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2005 BE GRANTED

'~ WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance ~
fiom BROOKHURST SHOPPING CENTER, INCARPORATED, 2293 West Ball Road, Anaheim, California 92804,
Owner; H. RALPH LOVETT, 4921 Durfee Avenue, Pico Rivera, Calif.ornia 90660, Agent of certain
real property situated in the City of Anaheim, County of Orange, State of California, described
-~- in Exhibit "A". attached hereto and referred to herein as though set forth in fuli f
e~ t`.,~_
; and
WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim
on AUgust 26, 1968~ at 2:00 o'clock P.M., notice of said public hearing heving been duly given as required
by law end in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.68,to hear and consider
evidence for and egainst said proposed variance end to investigete and make findings and recommendations in connec-
tion therewith; and
WHEREAS, said Commission, after due inspection, investigation, end study made by itself and in its behalf,
and after due consideration of all evidence and reports offemd at said heering, does find and determine the following
facts:
1. That the petitioner rec~uests a variance from the Anaheim Municipel Code: as follows~ to allow the
establishment of a U, S. Post Office on subject propert.y:
SECTION 18.08.440 3 - Establish a parcel of land not having frontage on a
public dedicated street.
2. That there are exceptional or extraordinary circumstences or conditions epplicable to the propecty involved
or to the intended use of the property that do not apply generalIy to the property or cless of use in the same vicinity
and zone.
3. That the requested varience is necessary for the preservation and enjoyment of a substantial property right
possessed by other property in the same vicinity and zone, end denied to the property in question.
4. That the requested verience will not be materially detrimental to the public welfate or injurious to the pmp-
erty or improvements in such vicinity and zone in which the property is located.
5. That although subject property has a 15-year lease for post office use, it is
part of the existing shopping center and frontage on a dedicated street should be assumed,
since parking will be part of the overall parking area of the shopping center.
6o That the Commission considers it unnecessary to construct modified cul-de-sacs
at the terminus of the frontage road and Pandora Lane, on the basis that the streets to
be cul-de-saced are not within the jurisdiction of the ~ity of Anaheim.
7. That the agent for the petitioner stipulated to providing an overail plan for
resiriping and landscaping the entire shopping center parking area, which will include
the post office parcel; said plans and development of the parking area to be accomplished
within the next year, such plans to be submitted to the Development Services Department
for approvalo
