A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
, THAT PETITION FOR CONDITIONAL USE PERMIT N0. Y055 gE GRANTED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Conditional
Use Permit from NATHAN SMOOKE, 701 North Sierra Drive, Beverly Hills, California 90210, OWner;
JACK WELCH, 2g55.Cypress Street, 0akland, California 94608, Agent.of certain real property

WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City of Anaheim on
August 26~ 1968~ at 2:00 o'clock P,M., notice of said public hearing having been duly given es required by
law and in accordence with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear and consider eyidence
for and agair.st said proposed conditional use and to investigate and meke findings and recommendetions in connection
therewith; end
WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and
after due cronsideration of all evidence and reports offered at said hearing, does find end detetmine the following facts:
~ 1. Thet the pcoposed use is properly one for which a Conditional Use Permit is authorized by Code~
Section 18,52.050(1-a) to wit: continue the sale and servicing and repair. of. small tractors
with waivers ofs
SECTION 18.52 020 -_P_ermitted M-l.uses. (Primary retail sales not permitted;
primary retail sales proposed).
SECTION 18,52.060(3-b)- Reauired enclosure of outdoor disolav areas. (6-foot masonry
wall required; none proposed).
2. That the proposed use will not adversely affect the adjoining land uses and the growth end development of
the area in which it is pioposed to be located.
3. That the size and shape of the site proposed for the use is adequate to allow the full development of the
proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of
the Citizens of the City of Anaheim.
4. Thet the granting of the Conditional Use Pennit under the conditions imposed, if eny, will not be detrimental
!o the peace, health, safety, and general welfare of the Citizens of the City of Maheim.
• 5, That under the authority of Section 18.64.0"/O, waiver of the required 6-foot
masonry wall to permit the display of tractors is hereby granted.
6. That under the authority of Section 18.64.070, waiver of the permitted uses in
the M-1 Zone to allow primary retail sales is hereby granted.
7. That the petitioner stipulated to display of the tractors only to the rear of
the 50-foot building setback.

NOW, THEREFORE, HE IT RESOLVED that the Aneheim City PlenaIng Commission does hereby grant subject
Pctltlon for Conditional Uae Permit, upon the followIng conditions which are hereby found to be a necessary prerequisite
to the proposed use of Ehe subject property in order to preserve the sefety and general welfare of the Cltizens of the
Clty of Aneheim:
1. That the ownps of subject property shall pay to the C~ty of Anaheim the sum of 52.00 pex
fr.ont foot along Katella Avenue, for street lighting purposes.
2. That the sicewalks shall be installed along Katella Avenue,,as required by the City
Engineer..and in accordance with standard plans and specifications on file in the office of the
City Engineer, .piior to final building and zoning inspections.
3. That trash storage areas shall be provided in accordance with approved plans on file
with the office of the Director of Public Works.
4, That fire hydrants shall be installed as required and determined to be necessary by the
Chtef of the Fire Department:
5. That any air-conditioning facilities proposed shall be properly shielded from view.
6. That Condition No. 1, above mentioned, shall be complied with prior to the time that
the Building P~mit is issued or within a period of 180 days from date hereof, whichever occurs
first, or such further time as the Commission or City Council may grant.
7. That Condit.ion Nos. 3, 4, and 5, above mentioned, shall be complied with prior to final
building and zoning,inspections. ~
8. That 'subject property shall be developed substantially in conformance with the M-1
site development standards and specifications on file with the City of Anaheim, marked Exhibit .
Nos. 1 and 2, and further provided that alI outdoor display shall be maintained to the rear
of the 50-foot building setback, as stipulated by the petitioner.
