A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE H0.2013 BE APPROVID
WHEREAS, the City Planning Commission of the City oE Meheim did receive a verified Petition for Vedance from
M. J. GOBERT, 431 North Magnolfa Avenue, Anaheim,.California 92801, Owner; COV.INGTON BROTHERS
I:ONSTRUCfION COhiPANY, 2451 Eas~ Orangethorpe Avenue, Fu1lFSton, California 92633., ?gent.of certain
real property~situated in the.City of Anaheim, County of Orange, State of Califorrnla, described as
the South 320 feet .of the North 666 feet of the:Bas.t half .of the. Northeast quarter of the South-
east quarter of Section 12-4-11, in the Rancho Los Coyotes, as shown on a map thereof recorded in
~.book 51, page 11, Miscellaneous Maps, records of said Orange County.
; and
WHEREAS, the City Planning Commission did hold e public hearing at the City Hell in the City of Anaheim on
September 11~ 1968~ at 2:00 o'clock P.M., notice of seid public hearing heving been duly givm as required by
law and in accoxlence with the provisions of the Aneheim Municipal Code, Chepter 18.68, to hear and consider evidence for
snd egainst said pcoposed variance and to investigate end make findings and cecommendations in connection therewith;
and
WHEREAS, seid Commisaion, after due inspection, investlgetion, end study mede by itselE end in its behelf,
and aEter due consideration of all evidence end repoRs offered at seid hearing, does find end determine the following
facts:
1. That the petitioner requests a varience from the Anaheim Municipel Code as follows, to permit develop-
ment of subject property with a 112 unit apartment development:
SECTION 18,28.050(5-b) - Maximum buildina heiaht. (One-storv within 150 feet of
single-family zone; (R-A) permitted; two-___ s___~torv within 14
feet of a single-family zone (R-A) proposed).
SECTION 18.28.050(6-a-4 - Minimum repuired vard setback. (15-foot setback from
property line required; 7-foot setback from prope~ty line
proposed).
2. That there are exceptional or extraordinary circumstances or conditions applicable
to the property involved.or to the intended use of the proper.ty that do not apply 9enerally
to the.property.or class of use in the same vicinity and zone.
3. That the requested variance is necessary for the pr eservation and enjoyment of a
substantial property right.possessed by other property in the same vicini.ty and zone, and
deni.ed to the pr.operty in question.
4. That the requested variance will not be materially detrimental to the pubiic welfare
or injurious to the property or improvements in such vicinity and zone in which the property
is located.
5. That plans.of devt~lopment propose a landscaped planter in the center of the cul-de-sac,
and if instailed it shall be in accordance with the provisions of City Council Policy No. 532.
6. That due to i:he fact the property to the north is the only undeveloped R-A parcel
between subject.property and Crescent Avenue and th2 property in this a:ea is indicated on
the General Plan f.or medium density residential use, the posting of a bond to insure con-
struction of a masonry wali should be considered appropriate in the event the R-A parcel to
the north is developed for a less intense residential use.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject
Petition for Varience, upon the following conditions which are hereby found to be a necessary prerequisite to the pro-
posed use,of Yhe subject property in order to preserve the safety and general welfere of the Citizens of the City of
Anaheim.
r ~` 1. That this variance is granted subject tothe completion of Reclassification No.
66~67-59.
2. Tha.t .tr_ash storage areas shall be prov.ided in accordance with approved plans on file
with.the.office.of.the Director.of Public Works.
3..That,.fire hydrants sha11 be installed as required and determined to be necessary
by.'che .Chief of the Fire Department.
4..That a..6-foot masonry wall shall be~constructed along the north property line, and

a.a ond in_form.and.amount satisfactory to the City of.Anaheim may be posted to insure
the:construc~rion of the:masonry wall in the event the R-A parcel to the north does.not

.. 5. That any air-conditioning facilities proposed shall be properly shielded from view,
and.the sound shall be buffered from adjacent residential homes.
6.,That the owner.of subject propErty shall pay to the City of Anaheim the sum of $25.00
per dwelling:.unit .to be.used f.or park .and recreation purposes.
7. That Condition Nos. 2, 3, 4, and 5, above mentioned, shall be cbmplied with prior to
f inal building and zoning inspections.
