A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2~16 BE GRANTED
R'HEFtEAS,' the City Plenning Commission of the City of AneheIm did receive e verified Petition for Vedence
from BR~OKHURST SHOPPING CENTER, 2293 West Ball Road, Anaheim, California 92804, Owner; MYLFS
BADER, 1365 East 16th Street, Los Angeles, Calif.ornia 90021, Agent of certain real propesty
situated in the City of Anaheim, County of Orange, State of California, described in Exhibit
"A" attached hereto and referred to herein as though set forth in full
; and
WHEREAS, the City Pienning Commission did hold e public hearing et the City Hell in the City of Anaheim
on S eptember 11, 1968~ et 2:00 o'clock P.M., notice of seid pubiic hearing heving been duly given es reqaired
by law and in accordenoe with the provisions of the Meheim MunicIpel Code, Chepter 18.68, to heer and consider
evidence for and ageinst said proposed verience and to investigete and meke F.indIngs end recommendetions in connec-
tion therewith; •and
WHEREAS, seid Commission, after due inspectlon, investigetion, end atudy mede by itself end tn its behelf,
and eEter due consideretion of eli evidence and repods offeredat said headng, does find and deteenine the following
fects:
1. That the petitioner requests e veriance from the Anaheim MunIcipal Code as f ollows, to permit outdoor
flower sales from a kiosk located in the shopping center parking lot:
SECTION 18.40.020 - Uses conducted whollv within a buildina reauired; outdoor sale
of flevers proposed.
2. Thet there ere exceptional or extreordinery circumstences or conditions eppliceble to the propetty involved
or to the intended use of the property thet do not epply generally to the property or class of use in the seme vicinity
and zone.
3. That the ~equested varience is necessary for the preservation end enjoymmt of a aubstential property right
possessed by other property in the same vicinity and zone, and denied to the peoperty in question.
4. That the requested variance will not be meteriaily detrimental to the public welfate or Injurious to the pmp.
eety or improvements in auch vicinity end zone in which the pmpeety is loceted.
5. That the petitioner stipulated to the Commission that the outside sale of the
flowers in this location would continue to no later than January 1, 1969, when a new type
of structure designed to enclose the entire operation would be erected.
