A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FGR VARIANCE N0. 2009 gE APPROVED
WHEREAS, the City Plenning Commission of the City of Aneheim did receive a veriEied Petition for Verianca from
ARTHUR L. OSOWSKI, 623 North Harbor Boulevard, Fullerton, California 92632, Owner; JAM£S Ro
HOLLEI~IDECK, 331 North Hart Place,'Fullerton, California 92631, Agent of certain real
property situated in the City of Anaheim~ County of Orange, State of California, described
as The South 100 feet of the North 560 feet of the East 448 feet of the Northeast quarter
of the Northeast quarter of Section 13.in Iownship 4 South, Range 11 West, San Berr.ardino
Base and Meridian.
; and
WHEREAS, the City Plenning Commission did hold a public hearing at the City Hali in the City of Anaheim on
September 23~ 1968, et 2:00 o'clock P.M., notice of said public hearing having been duly given es required by
law and in accordence with the provisions of the Anaheim Municipal Code, Chepter 18.68, to hear end consider evidence for
and against said proposed veriance and to investigate and make finding's and recommendations in connection therewith;
and
WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf,
and after due consideration of all evidence and repocts offered at said hearing, does find and deteanine the following
facts:
1. That the petitioner requests e veriance from the Aneheim Municipal Code, as follows, to construct a
two-story 24-unit apartment complex on subject property:
SECfION 18,28.050(5-b~, - rvtaximum buildina heipht within 150 feet of an R A Zone.
(One-storv permitted; two-storv proposed).
SECTION 18,28.050(7-a) - Minimum distance between buildinps.(28 feet required;
19 f eet proposed).
SECTION 18,28.050(9-b) - Maximum oermitted distance of a livinq unit from a
standard street. (200 feet permitted; 330 feet proposed).
SECTION 18,28.050(11~, - Recauired walls. (North property line). (6-foot masonry
wall required; none proposed),
2. That there are exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use of the property that do not apply generally
to the property or class of use_in the same vicinity and zone.
3. That the requested variance is necessary for the preservation and enjoyment of a
substantiai property right possessed by other property in the same vicinity and zone, and
denied to the property in question.
4. That the requested variance wiil not be matarially detrimental to the public welfare
or injurious to the property or improv~nents in such vicinity and zone in which the property
is located.
5~ That one person appeared in opposition to the request for waiver of the masonry
wall along the north property line.

NOW, THEREFORE, BE 1T RESOLVED thet the Aneheim City Planning Commission does hereby grant subject
Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to the pro-
posed use of the subject property in order to presecve the safety and general welfere of the Citizens of the City of
Anaheim..

68-69-22.
2. That the sidewalks shall be.instelled along Magnolia Avenue, as required by the
~ity Engineer and in accordance with standard plans and specifications on fi.le in the office
of the City ~ngineer.
3. I'hat trash storage areas shall be provided in accordance with approved plans on file
with the.office of the Director of Public Works.
4o That f.ire hydrants shall be installed as required and determined to be n2cessary by

tP~e Chief of the.Fire Department.
~ '+' 5. That any air-conditioning facilities proposed shall be proper.l.y shielded from view,
,~h ; and the,sound shall be buffered from adjacent residential homes.
~ 6. That subject property shall be developed substantially in accordance with plans and ~
ti~ ; specifications on file with the City of Anaheim, marked Exhibit Noe 1, provided however, that
: the alley shall be extended westerly, and that the carports.shall be relocated to accommodate !

7. That ~ondition Nos. 2, 3, 4, and 5, above mentioned, shall be complied~with prior ;
to final building and zoning inspections. ~
