N. BRISTOW, 559 South Swidler Place, Orange, California 92667, Agent of certain.real property situated in the City of Anaheim, County of Orange, State of California, described in Exhibit "A" attached hereto and referred to herein as though set forth in full ; and j WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on NOVembps~ 4~ 1gbg, et 2:00 o'clock P.M., notice of said public hearing heving been duly given as required by . i lew and in accordence with the pmvisions of the Anaheim Municipel code, Chepter 18.64, to hear and consider evidence ~;j for and egeir.st seid proposed conditional use and to invesGgate and make findings end recommendeGons in connection ° `i therewith; end ~ j WHEREAS, said Commission, af!ec due inspec4on, investigetion, and study mede by itsetf and in its behalf, and = after due consideration of all evidence and reports offered at said hearing, does find and deteenine the following facts: ; ~; 1. That the qroposed use is properly one for which a Conditional Use Pennit is authorized by Code: :~ Section 18.64.020(3-g) to wit: establish a bus depot in an existing structure, with waiver ;l of: SECfION 18.62.030~i-5) - M~ximum oermitted oroiection of a wall S~nn, (16 inches maximum permitted p,rojection; ~g~ proposed). 2. That the proposed use will not advetsely affect the odjoining land uaes and the growth end development of the acea in which it is proposed to 6e located. 3. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particuler erea nor to the peace, health. safety, and general welfare of the Citizens of the City of Anaheim. 4. That subject property is a part of the commercial-recreation area, and as such, dedication for street widening purposes along Haster Street would be required; however, waiver of the required dedication is granted until such time as rede4elopment of or other disposition is made of the prop~erty, due to the nature of the proposed utilization of an existing structure, and the future revamping program for the Santa Ana Freeway by the State Division of Highways. 5. That subject petition should be granted for a period of one year, at which time the Development S ervices Department shall r eview uses which were estabbished and the parking as developed, and whether dedication for Haster Street is necessary, and to determine whether a n eN public hearing shail be'set.to be~heard before the Planning Commission. , 6. NOW~ THEREFORE, BE IT RESOLVED that the AnaheIm City P1annIng Commission does henby grant subject PefItion for Conditlonel Use Permit, upon the following conditlons which ate hereby found to be a necessery prerequIsite to the proposed use of the subject property in order to preaerve the safety end generel aelfaee of the Cittzens of the City of AnaheFm: 1. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 2. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 3. That any air-conditioning facilities proposed shall be properly shielded from view. 4. That Condition Nos. 1, 2, and 3, above mentioned, shall be complied with prior to final building and zoning inspections. i. 5. That subject petition is grant xl for a period of one year, after which time it shall be reviewed by the Development Services Staff to determine what effect the uses of the property have had on the area, whether parking has been adequate, whether dedication for Naster Street is needed and whether a further public hearing should be scheduled to determine whether the use should be continued. If no public hearing is held, and the petitioner desires to continue the use of the property for the purpose requested, he may request an additional one year for the use from the Planning Commission.
