WHEREAS, the City Plenning CommIssion of the City of Anaheim dId receive e verified Petition for Verience from
ANGEL LERMA MALER AND ALMA CLARA MAL~R, 2441 West Lincoln Avenue, Anaheim, California 92801,
Owners; ROBERT R. PRALLE, 10750 Oak Stre'et, Stanton, California 90680, Agent of certain real
property situated in the City of Anaheim, County of Orange, State of California, described in
Eichibit "A" attached hereto and referred to herein as though set forth in full

'~ ; WHEREAS, the City Plenning Commission did hold a public heering at the City Hall in the City of Anaheim on
December 2, 1968~ et 2:00 o'ciock P.M., notice of said public hearing having been duly given as required by
~ law end in accordence with the provisions of the Anaheim Municipel Code, Chapter 18.68, to hear end consider evidence for
and ageinst said proposed varience end to investigete end meke findings and recommendations in connection therewith;

WHEREAS, said Commission, efter due inspection, investigation, end study made by itself and in its behalE,
and after due consideration of ell evidence and reporta oifered at said hearing, does find and determine the following

1. Thet the petitioner requests e verionce from the Aneheim Municipel Code:as foliows, to establish a
109-unit apartment complex on subject property:
SECTION 18.28.050(5-b) - Maximum structural heiaht within 150 feet from sincale-
family residential property (R-A), (One-storv pexmitted
within 150 f eet; two-storv proposed).
SECTION 18.28.050~6-c) - Location of accessorv buildinc~s. (Accessory buildings
permitted adjacent to side property lines in the rear

in the r ar 66 of the property proposed).
SECTION 18.28.050(7-a) - Minimum distance between buildings. (29 and 28 feet
required; 10 and 10 f eet proposed).
SECTION 18.28.050(9-b) - Distance of livina units from a standard street. (Within
200 f~ required; within 22 f t proposed).
2. That there are exceptional or extraordinary circumstances or conditions applicable
ta ':he property involved or to the intended use of the property that do not apply generally

3. That the requested variance is necessary for the preservation and enjoyment of a

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject
Petition for Variance, upon the following conditions which are heceby fuund to be a necessary prerequisite to the pro-
posed use oE the subject property in order to pceserve the sefety and general welEace of the Citizens of the City of
Anahelm.
L. That this variance is granted subject to the completion of Reclassification No.
68-69-52.
2. That subj ect property shall be developed substantially in accordance with plans
and specifications on file with the ~ity of Anaheim, marked Exhibit Nos. 1, 2, 3, and 4.
