A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1082 BE GRANTED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Conditional
UsePermitfrom OMY Ao JACKSON, 170 Brooklir,e, Costa Mesa, California 92626, Owner; PANCAKE
CAROUSEL, 123•9 North East Street, Anaheim, California 92805, Agent of certain real property
situated in the City of Anaheim, County of Orange, State of California, described in Exhibit
"A" attached hereto and referred to herein as though set forth in full
; and
WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City of Aneheim on
December 30, 1968, at 2:00 o'clock P.M., nolice of said public hearing heving been duly given as required by
law and in accrordance with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear and consider evidence
for and agair.st said proposed conditional use and to investigate and make findings and recommendetions in connection
there•aith; and
WHEREAS, said Commission, after due inspection, investigation, and study mede by itself and in its behalf, and
after due consideration of all evidence and reports offered at said heering, does find and determine the following facts:
1. That the proposed use is properly one for which a Conditional Use Permit is authorized by Code,
Section 18.52.050(1-g) to wit: permit on-sale beer and wine in conjunction with the serving
of ineals in an existing restaurant.
x• 2. Thet the proposed use will not adversely affect the edjoining land uses and the growth and development of
< the area in which it is proposed to be located.
3. Thet the size and shape of the site proposed for the use is adequate to allow the full development of the
proposed use in a menner not detrimental to the particular area nor to the peace, health, safety, and general welfere of
: . the Citizens of the City of Anaheim.
: 4. That the gcanting of the Conditionel Use Pennit undet the conditions imposed, if any, will not be detrimental
,t, .,,,, ,`i to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim.
5. That due to the fact that the petitioner had indicated the serving of beer and wine
~` would be an incidental use in the serving of food and no bar was proposed, the use would not
w ' be detrimental to the adjoining land uses; furthermore, since another facility within a block
.~ : of subject property now serves alcoholic beverages, the denial of subject petition would
deprive the petitioner of a right enjoyed by others in close proximity.
