WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from
JOHN PRIFIJ, 2546 West Lincoln Avenue, Anaheim, California 92801~ O~vner; JANFS ROE, 11821 South
Pounds, Whittier, California 90604, Agent of certain real property situated in the City of
Anaheim, County of Orange, State of Cali:ornia, described as the South 243 fcet of the lJortnwest
quarter of the Southwest quarter of the Southwest quarter of Section 14 in I'ownship 4 South
Range 11 West, in the Rancho Los Coyotes, as shown on a Map recorded in book 51, oage 11 of
Miscellenaous iViaps, records of said Orange County. Except the South 158 feet of the'Nest 343
feet thereof. Also exceot the Easi 260 feet thereof

WHEREAS, the City planning Commission did hold a public hearing at the City Hel] in the City of Anaheim on
February 14~ 1968~ at 2:00 o'clock P,M., notice of said public hearing having been duly qiven as required b,y
law and in accordance withthe pcovisions of the Aneheim Municipal Code, Chapter 18.68, to hear and consider evidence for
and egainst said proposed variance and to investigete end make findings end recommendations in connection therewith;
and
WHEREAS, said Commission, after due inspection, investigation, end study mede by itself end in its behalf,
and efter due consideration of all evidence and reports otfered at said hearing, does find and determine the following
fects:
1. That the petitioner requests a variance from the Aneheim Municipal Code, as .`ollows, to permit the us e
of an existing residential structure for of:ice purposes.
SECTION 18.16.020 - Permitted uses in the R-A, Aaricultural, Zone (Proposed use
is not permitted in the R-P., Zor.e).

2. That the Anaheim General Plan indicates this area as being appropriate :or commercial
h' professional office uses, and although subject property is not zoned for commercial purposes,
f~ the Planning Commission feels that commercial consideration should be given to this entire
G" area and, therefore, has directed the staff to conduct a study and initiate C-0 Zoning on all
'~ appropriate parcels from subject property south to Ball Road.
~j<, 3. That the requested waivers of the maximum number of signs and distance between sians
is hereby denied on the basis that subject property is immediately adjacent to an R-1 sub-
division, and the proposed sign would create a visual intrusion and have a deleterious ef:ect
upon the residential properties. Therefore, only one free-standing sign of a maximum of 100
square f eet in area and a maximum of 15 feet in height shall be permitted on the oroperty.
4. That since only a portion of subject property is to be used for commercial ourooses
at this time, the required 6-Foot masonry wall need be constructed only where the commercial
development abuts the single-family residences to the north.
5. That there are exceptional or extraordinary circumstances or conditions applicable to
the property invo~ved or to the intended use of the prooerty that do not anoly oF~crzii~ ~o
the oroperty or class of u=_e in the same vicinity and zone.
- 5. That the requested variance, as approved, will not be materially detrimental to the
oublic welfare or injurious to the property or improvements in such vicinity and zone in which
the property is located.

NpW, THEREFORE, BE IT RESOLVID that the Anaheim City Planning Commission does ^ereby
grant subject Petition for Variance, upon the fol'owing conditions which are nereby four;d to be
a necessary prerequisite to the proposed use of the subject property in order to preserve the
safety and general welfare of the Citizens of the City of Anaheim:
1. That the owner of subject property shall deed to the City of Anaheim a strip of land 53
feet in width, from the centerline of the street along Knott Street, for street widening ~mposes,
2. That street improvement plans shall be prepared and all engineering requirements of the
City of Anaheim along Knott Street, such as curbs and gutters, sidewal~s, street grading and
paving, drainage facilities, or other appurtenant work shall be comoleted as required by the City
Engineer and in accordance with standard olans and specifications on file in tne o:r'ice of the
City Engineer; and that a bond in an amount and form satisfactory to the City of Anaheim sha11 be
posted with the City to guarantee the installation of said engineering requirements.
~ 3. That the owner of subject property shall oay to the City o: Anaheim the sum of $2.00 per
~~' front foot along Knott Street, for street lighiing purposes.
4. That the owner of subject property shall pay to the City cf Anaheim the sum o: 15~ per
frnnt foot along Knott Street, for tree planting purposes.
5. That trash storage areas shall be provided in accordance with aooroved plans on file
with the office of the Director of Public Works.
6. Ihat fire hydrants shali be installed as required and determined to be necessary by the
~ Chief o` the Fire Department.
7. That any air-conditioning facilities proposed shall oe properly shielded from view, and
the sound shall be buffered from adjacent residential homes.
8. That any external lighting proposed on suoject property shall be directed downN~ard and
away from abuttina property lines.
9. That the structure shall be brought up to the minimum standards o.` the Uniform Buildiny,
Plumbing, and Hlectrical Codes, as adopted by the City of Anaheim.
10. rhat Condition Nos. 1, 2, 3, and 4, above mentioned, shall be comolied with prior to
the time that the Building Permit is issued or within a period of 180 days from date herco:,
whichever occurs first, or such further time as th~e Commission or City Council may grant.

12. That a 6-foot masonry wall shall be provided along tne north property line to a death
of approximately 130 feet to separate the proposed commercial use from the single family

proposed parking area.

]4. That subject property shall be developed substantially in accordance ri~ith olans and
_ speciiications on file with the City of Anaheim; provided, however, that parking shall only be
provided to the rear of the prooerty, and the front setback shall be maintained with plant
materials, with r,o permanent parking permitted.
15. That as a condition of use the vacant oortion of subject property shall be maintained
in a neat and orderly manner.
