WHEREAS, the City Planning Commission did hold e public heering et the City Hall in the City of Maheim
on iti7arch 25, i968 y et ?:00 o'clock P.M., notice of sald public heering heving been duly given
as required by law and in eccordence with the pzovisions of the Maheim Municipel code, Chepter 18.64, to hear
and consider evidence for end ageinst said proposed conditional use t+nd to investigete ond meke findIngs and
recommendetions ir connection thcrewith; and

WHEREAS, seid Commission, efter due inspection, investigation, end study mede by itself end in its be-
helf, end after due consideretion of ell evidence and repor:s offered at said hearing, does find end determine the
following facts:
1. That the proposed use is properly one for which a Conditlonel Use Permit is euthorized by Co~.~:

property with •Naivers of:
SECTION 18.Q4.090 2-•a) - Minimum setbacks for churches (A minimum ot 15 Feet
required; 10 feet proposed adjacent to the south
property line. Also the 15•-foot setbacks adjacent
to the side and rear property lines shall not be
used for parking purposes - petitioner proposing
to have tha par};ing area within the 15-foot setback).
2. That the proposed use wiil adversely affect the ;djoining lend uses and the
growth ano development of the area in which it =~ orooosed to be located.
3. T:~at the size, shape, access, and orientatio~ oi the site prooosed :or the
churcn ^se is not ad=quate to aliow fo: orderly developmer.t or any future expansion
o* the proposed use in a manner that w.ould not be detrimental to the particular area
nor.to the peace, health, safety, and general welfare of the Citizens of the City o:

4. That in considering the selection of a church site, attention must be given

vrould not permit any expansion and still comply with Code requirements in terms oF'
parking and setbacks.
5. That five ozrsons aooeared, representing eleven persons present in the ~ouncil
Chamber, and a petition signed by 4' prope*ty owners was received, aII in opposition
to subjeci petition.
