WHEREAS, said Commission, after due inspection, investigetion, and study made by itself and in its behalf,
and efter due consideretion of all evidence and reports offered at seld hearinq, does find and determine the following
fects:
1. Thet the petitioner requests e veriance from thE Anaheim Municipel Code as follows, to develop a
694-unit apartment complex on subject property:

2. That the i:ommission grants Variance t4o. 2044, except foz those waivers either vaith-
drawn or denied as indicated below for Phase I onlv, and denied the request that said waivers
also apply to Phases II and II7, on the basis that plans of development were submitted in
detail for Phase I unly, and blanket approval of waivers, wherein 694 dwelling units are proposed
on the entire 29-acre parcel, might set an undesirable precedent.
3. T;,at waiver of the one-story height limitation v~ithin 150 f eet of the R-A parcel to the
west, which General Plan Amendment :do. 97 depicts as being appropriate for k-~-5000 or low-
medium density, is hereby denied un the basis that the Commission has approved the variance
requests for Phase I only.

4. That waiver of Section 18.U8.440, was withdrawn by the petitioner, since a condition
of approvzl of Tentative Map of Tract No. 6843 required the extension of a dedicated 20-foot
alley to the pazcel to the south on which no development is presently proposed.
5. That under the authority of Section 18,68.060, waiver of the one-story height
limitat;on +Nithin 150 feet of ±he R-p property to the east is hereby aranted, on the basis
that said property is adjacent to the flood control channel and due to its size and shape it
will undoubtedly develop for use other than single-family residential.
h. That the requested variance, as granted, is necessary for the preservat:on and
enjoyment of a substantial p:ope.^ty right possessed by other properties developed for multiple-
~ family uses.
7. That the requested variance, as granted will not be materially detrimental to the
public welfare or injurious to the property or improvements in such ~~icinity and zone in which
the property is located.
''~~ S. That the petitioner is advised that, by Resolution, the City Council has determined
~ buildine following park a~d recreation fe~, shall be applicable and payable at the time the
9 permit i; issued: 1) Issuance o~ a building p~r,nit on or prior to May 1, 1969 -$2g
per dwelling u~it; or 2) Issuance of a bui?ding permit subsequent to M~y 1, 1969, -$75 per
dwelling unit.
9. That ';he Commission rncommends to the City Council that standazd street ir~provement
, requirements bc amended to permit installation of sidewalks adjacent to the curbs of all
streets within th's Phase; this recommendation being based on the fact that area normally
having a parkway ma; then be incorporated into the front setback area thereby creating a laraer
landscaped area.
10, That the owner of a large acreage abutting subject property to the west, appeared in
opnosition to blanket approval of the requested waivers for the entix•e parcel.
NOIN, THEREFORE, BE IT R~FSOLVED that the Anaheim City Planning Commitsion does hereby
grant subject Petition for Variance, upon the following conditions which are hereby found
to be a necessary prerequisite to the proposed use of the subject property in order to
preserve the s~fety and gen?ral welFare of the Citizens of the City of Anaheim.
1. 7hat this variance is granted subject to the completion of Reclassification No.
68-69-13.
2. That fire hydrants shall be installed as required and determined to be necessary
by the Chief of the Fire Department.
3. That all streets vrithin the development shall be constructed in accordance with
standard plars and specifications on file in the office of the City Enaineer, except that the
sidcrralks may be located adjacent to the curbs, provided that the sidewalks are offset to the
rear of fire hydrants on all streets and utility poles on Frontera Street.
4. That a bond in an amount and form satisfactory to the City of Anaheim shall be posted
with the City to guarantee the installation of a 6-foot masonry wall along all property lines
where required by Code.
5. That any air-conditioning facilities proposed shall be properly shielded from view,
and the sound shall be buffered from adjacent rasidential homes.
6. That Condition Nos. 2, 3, 4, and 5, above mentioned, shall be complied with prior
to final building and zoning inspections.
7. That subject property shall be developed substantially in accordance vaith plans and
specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, 3, 4, 5, 6, and 7.
8. That ordinances recl8ssifying the property shall be adopted as each parcel is ready
to comply with conditions pertaininq to such parcel; provided, however, that the wora "parcei"
shall mean presently existin9 parcEls of record and any parcel or parcels approved by the
City Council for a lot split.
9. That the owners of subject property shall pay to the City of Anaheim park a~d
recreation f~es for each dwelling unit~ as required by City Council resolution, which shall be
usEd for park and recreation purposes, said artrount to be paid at the time the building permit
is issued.
