A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
T!iAT PETITION FOR VARIANCE NO. 2091 BE APPROVED
WHEREAS, the City Planning Commission of the City of Anaheim did receive e veriEied Petition for Variance ftom
JERRY VICI'OR MALER, 390 Camir.o Monte Vista, Palm Springs, California 92262, Owner; R. S.
MC MIC.HAEL, 4ti9-A Valencia Drive, Fullerton, California 92632, Agent af certain seal property
situated in the City of Anaheim, County of Orange, State of California, described in Exhibit
i "A" attachecl hereto and referred to herein as though set fosth in fuile
; and
WHEREAS, the City Planning Commission did hold a public heering at the City Hell in the City of Aneheim on
June 2, 1969, at 2:00 o'clock P.M., notice of said ublic h~arin havin Ueen dul
law and in eccocdene~ with the provisions of the Anaheim Municipal Code, Chepter 18,68, to hear end cos der evidence for
and against seid proposed variance and to investigete end meY.e findings end recommendetions in connection therewith;
and
WHEREAS, said Commission, after due inspection, investigation, and study mede by itself and in its behalf,
end after due consideration of all evidence and reports offeted at said heating, does find end detecmine the following
facts:
1. Thet the petltioner requests e variance fcom the Aneheim 4lunic3pel Code; as follows to permit the
construction o£ a 52•-unit apartment complex, with waiver ofs
1) SECTION 18028.050(6-b-3j - Minimum side vard setback. (5-feet required; 0-feet
for carports proposed),
2) SECTION 18.28.050(9-a) - Livinq units within 200 feet of a standard street.
(Within 200 feet required; within 250 feet proposed).
2. That there are exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use of the property that do not apply generally
to the property or class of use in the same vicinity and zone,
3, Tha•t the :equested variance is necessary for the preservation and en,joyment of a
substantial property right possessed by othe* prc;perty in the same vicinity and zone, and
denied to the property in questione
4, That +.he requested variance will not be materially detrimental to the pubiic welfare
or in~urious to the property or improvements in such vicinity and zone in which the property
is located.
5. That no one appeared in opposition.
