r WHEREAS, the City Plenning Cammission of the City of pnaheim did reccive e verified Petition for Variance from
MARIE E. BORCHARD ESTATE, THON~AS c'. HEFFERNAM, EXECUTOP,, 350 East 19th Street, Ccsta Mesa,
Caiifornia 92627, Ovaner; DOWNEY SAVINGS AND LOAN ASSOCIATION, 8630 ~ast Florence, Downey,
California 90240, Agent of certain real property situated in the City of Anaheim, County of
Orange, Stata of California, described in Exhibit "A" attached hereto and rEferred to herein

WHEREAS, the City Plenning Commission did hold a public hearing et the City Hell in the City of Aneheim on
June 30~ 1969~ at 2:00 o'clock P.M., notice of said public hearing heving been dul
law end in accordance with the provisions of the Anaheim Municipal Code, Chepter 18.68, to hear and cons der evidence or
and against said proposed veriance end to investigate and make findings end recommendetions in connection therewith;
and
WHEREAS, seid Commission, after due incpection, investigetion, ar.d study mede by itsel( and in its behalf,
end after due consideration of all evidence and reports offered at seid heering, does find end determine the following
facts:
1. That the petitioner requests e vorience from the Aneheim Municipal Code, as follov~s, to p?rmit the
subdivision of subject property into 118 R-1, One Farnily Residential, Zoned lots.
SEC7IGN 18~24.030(4) - ~dinimum_iot width. (?0 feet required; 60 feet for the
majority of the lots proposed)~
2~ That there are no exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use of the property that do not apply genc:rally
to the property or class of use in the same vicinity and zone.
3a That the requested variance is not necessary for the preservation and enjoyment of
a substantial property right possessed by other property in the same vicinity and zone, and
denied to the property in quest:on~
4. That the requested variance tivill be materially detrimental to the public welfare
and injuri.ous to the property cr improvements in such vicinity and zone in vihich the property
is located.
5, That the size and shape of subject property is adequate to subdivide the prop~~rty
and cumply with Code requiremen~s as to tividth and squa:e footage.
6a That the petitioner had not submitted evidence that a hardship pxisted to r~arrant
favorable consideration of th? waiver requested.
7. That 8 persons appeared, representing 25 persons present in the Council Chambe:, all
in opposition, and a petition signed by 52 persons vaas received, also in oppositi.on to subject
