[~*~r~~ THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1120 BE GnA.~'.T~D 1 WI~REAS, the City Counoil of the City of Anaheim did initiate a verified Petition for Conditional Use Permit on certain real property s=tuated in the City of Anaheim, County of Orange, State of California, described in Exhibit "A" attached hereto and referred to herein as though set forth in full; and WF~REAS, the City Planning Commission did hold a public hearing at the Anaheim Stadium in ~;~~ the City of Anaheim on June 18, 1969 at 7:30 o'clock P.M., notice of said public hearirg having been duly given as required by law and in accordance with the provisions of the Anaheim Municipe,l Coc'e, Chapter 18.64, to hear and consider evidenoe for and against said proposed conditional use ~ and to investigate end meke findings and recommendations in connection therewith; and 1NH~~REAS, said Commission, after due inspection, investigation, and study made by itself ar.d in its behal:', and after due consideration of all evidence and reports offered et said hearing, does find and determine the following fects: 1. That the proposed use is properl5~ one £or which a Conditional Lse Permit is authorized by Code: Section 18.64.020(3-a) to viit: establish a Metroport with relatecl facilities on subject property. 2. That the proposed use will not adversely affeat the adjoining land uses and the growth and deuelopment of the area in which it is pr~posed to be located. 3. THat th:e size and ~hape of the site proposed for the use is adequate to ~llow the full dev8lopment of the proposod use in a manner aot detrimentel to the perticular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Ansheim. 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the pesce, health, safety, and general welfare of the Citizens of the City of Anaheim. J 5. That in a report entitled "Anaheim Adetroport", which was part of a comprohensivo air _ and surface transportation study for tlie groater Anaheim Area, it was indicated that a definite need for an air transportetion facility in Northern Orange County, and specifically Anaheim, was apparant due to the phenomenal growth of air passen~er traffio in Southern California which is overtaxing Southern California's regional airport system. 6. That the proposed Metroport would provide for short-heul faailities for expeditious movement of persons and commodities between speoific destinations under 400 miles, and would have design requirements considerably reduced from the conventional ai:por'~ becaus•;~ STOL and VTOL aircraft Nould serve the fe,cility. 7. That the flight pattern for the proposed site, which is lor,ated in the Southeast Tndustrial Area, would be primarily contained over aress either zoned or planned for industrial use in the City of Anaheim and the City of Orange, and the approach and departure pattern would basically follow the River and the Santa Ana Freeway; x~ould be in close proximity to traffic generatir.g centers; and that it would be located at the apex of several freewsys i;hereby providing good acces~ in ell directions. 8. That the location of shori:-haul metroports should be within ten minutes driving time of the population to bo served. 9. That 17 persons appeared, representing approximatoly 400 persons present from both the City of Anaheim and the City of Orange, all in opposition; and that le±t~rs from the Anaheim Chamber of Commerce and industries were received in favor of tho proposed Pdetroport. O f.~ ~ , . _ -- ; NOW~ THEREFORE, BE IT RESOLVED that the Anaheim City Planaing Commission does hereby grant subjeot Petition for Conditional Use Permit, upon the follawing conditions which are hereby found to be a neoessary prerequisit e to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Ar.aheim; 1. That noise levels of all airaraft utilizingthe Metroport shall not exceed the noi~e levels developed by the DeHavilland Twin Otter or shsll in no event exceed 100 PNDR on take-off. ; (All sound readings to be made in acoordance with accepted measuring standards.) 2• That pure jet airor.aft shall noi; be Permitted to operato from this facility. ' 3. That aircraft shall be required •to enter the flight pattern in conformanae with Federal ~ Aviation Administration (FAA) regulations and where~rer possible, approach the pattern elong the freeways or the Santa Ana Ri,ver. Tho flight pattern shall be in accorde,nce , with thet approved by the FAA and State Denertmont of Aeronautics and be in substantial accord with the design shown on Exhibit A, on file wi+h the Ciiy of Anaheim. 4. That conditions of operatior, shall, at all times, conform to i;he limits of all FAA requirements, provided that operations of the facilit~ shall be conducted in accordance with visuel flight rules (VFR), and during daylight hours onl;~. -. 5. That airoraft shall be equipped with Decca instrumentetion or an equivalent system when it becomes aveilable aiid is approved by the FAA, 6. That the activities permitted in connoction with the Metroport shall be limited to those operations and facilities necessary for the handiing of pessengers and their bagga¢e, including, but not limited to ticket counters, restaurant, ar.d other related facilities neoessary for passenger servioe. 7. That the storage, shipment, or handling of any type o£ froight or cargo shall not be permitted. 8. That repair and ma,intenance o~ airoraft shall be limited to "third echelon mctintenance" (r^:inor repairs and adjustments only). 9. That"run-up" of aircraft engines shall be permitted only in connection with te.ke-o~f and iristrument cheok prior to take-off. ~~I 10. ~'hat any substantial and persistent violation of thu flight pattern established by the City of Anaheim and approved by the FAA and State Department of Aeronsutics (Exhibit "A") shall be considered a breach of conditions. 11. That should any deviatlon from the foregoing aonditions or any proposed chenges in conneation with the operation of the Metroport be desired in the future, such deviations or changes shall be brought before the City Counail of the City of Anaheim at a public hearing, and receive approval of that body before being put into effect. Notifioation of the required public hearing shall be eccomplished in aocordence with the Laws of the State of Californie with the addition, that notice of said hearing shall be made by U. S. Mail to: 1) all property owners within 300 feet of the ~Letroport site; 2) throe persons within the City of Anaheim to be designated by the homeowne:•s' group as representatives of their group; and 3) the City Clerk of the City o~ Orange. 12. That violation of any of i:he foregoing conditions shall bo grounds for revocation of the conditione,l use permit. 13. That subject property snall be developed substentially~ in accordance with plens on file with the City of Ana~eim, marked Exhibits A, B, and C.
