PC 69-152RESOLUTION NO PC69 -152 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT NO. 1123 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Conditional Use Permit from L. KENNETH HEULER, ET AL, 220 West Cypress Street, Anaheim, California 92805, Owner; JACK ADELSTEIN, 14122 Hubbard Street, San Fernando, California 91342, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as the Easterly 233 feet of the East half of that portion of the Southwest quarter of Section 4, Township 4 South, Range 10 West partly in the Rancho Los Coyotes, and partly in the Rancho San Juan Cajon De Santa Ana, as per map recorded in Book 51 Page 10 of Miscellaneous Maps, in the office of the County Recorder of said County. Beginning at the intersection of the South Line of said Section with the East line of the West 416.00 feet of said Section; thence Northerly along said East line to the South line of Lot 2 as shown on a Map filed in Book 1 Page 55 of Record of Surveys in the office of the County Recorder of said County; Thence East along said South line to the Southwest corner of Lot 3 as shown on said record of survey; thence Southerly along the Southerly prolongation of the West line of said Lot 3 to the South line of said Section; thence West along said South line to the point of beginning. Said land is included within the area shown on a Map filed in the office of the County Recorder of said Orange County, in Book 32 Page 45 of Record of Surveys. ; and WHEREAS, the City Planning Commission did hold s public hearing at the City Hall in the City of Anaheim on July 14, 1969, at 2 :00 o'clock P.M., notice of said public hearing having been duly law and in accordance with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear and consider evidence nce for and against said proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a Conditional Use Permit is authorized by Cod' Section 18.64.020(2 -b) to wit: establish a 100 -bed convalescent rest home on subject property. 2. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. C1 -G - 1- NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be • necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That this conditional use permit is granted subject to the completion of Reclassi- fication No. 66- 67 -75. 2. That a Parcel Map to record the approved division of subject property be subrritted to th City of Anaheim for approval and then be recorded in the office of the Orange Count.. fiecord,r. 3. That the sidewalks and driveways shall be installed along La Palma Avenue fronting both parcels, as required by the City Engineer and in accordance with standard plans and speci- fications on file in the office of the City Engineer. 4. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 5. That fire hydrants shall be installed as required and determined to be necessary by tL'. Chief of the Fire Department. 6. That a 6 -foot masonry wall shall be constructed along the east and north prop,ty lines. 7. That a $300 cash bond shall be posted with the City of Anaheim to guarantee payment of a proportionate share of the cost of constructing a modified cul- -sac at the westerly terrain, of Glen Drive, when the property to the north of subject property is developed. 8. That any air - conditioning facilities proposed shall be properly shielded from vie:;', and the sound shall be buffered from adjacent residential homes. 9. That Condition Nos. 2, 3, 4, 5, 6, 7, and 8, above mentioned, shall be complied with prior to final building and zoning inspections. 10. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit No. 1. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Orange Avenue and Velare Street, for street lighting purposes. 2. That the owner of subject property shall pay to the City of Anaheim the sum of 15c per front foot along Orange Avenue and Velare Street, for tree planting purposes. 3. That trash storage areas shall be provided in accordance with approved plans on file with the office cf the Director of Public Works. 4. That any air- conditioning facilities proposed shall be properly shielded from view. 5. That the structure shall be brought up to the minimum standards of the Uniform Building, Plumbing, and Electrical. Codes as adopted by the City of Anaheim. 6. That Condition Nos. 1, 2, 3, 4, and 5, above mentioned, shall be completed prior to the commencement of the use approved under this conditional use permit. 7. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit No. 1. 8.
