WHEREAS, the City Planning Commission of the City of AneheIm did receive a verified Petition fo: Variance from

WHEREAS, seid Commission, ofter due inspection, investigetion, end study mede by itself end in its behalf,
and after due consideration of all evidence and reports offered at said hearing, does find end deter:niae the following

1. Thet the petitioner requests a veriance from the Aneheim Municipal Code as fol lot•rs, to establ ish a
22•1-unit, two-story apartment complex on subject property:

Planning Commission has recommended amendments to Title ]$ of th? Anaheim ~~iunicipa] Code which
would permit this waiver by right; however, the City Council has not as yet considered said
recommendations Gt public hearing, nor adopted an ordinance amending Title 18 to reflect these
changes.
3. That the petitioner stipulated that proposed patio walls located in the Counr.il nolicy
35-foot setback for Lincoln Avenue would be no higher than 4~ inches.
4. That the petitioner stipulated to submission of ievisid plans v;hich would reflert
access and circulation for fire and trash vehicles in ~ccordance with t~ie reyuirements oi the
Chief of the Fire Department.
5. That there are ex,ceptional oz extraordinary circumstances or conditions applicable to
the property involved or to the intandcd use of the proF.~rty thai. do nc~t apply gen~_rally to the
property or c~ass of use in the same vicinity and zone.
6. That the requested :-ariance is necessary for the preserv~tlon and enjoyment of a
substantial property right possessed by other property in t:he same vicinity and zone, and ~ienied
to the property in question.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject
Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to tne pro-
posed use of the subject property in order to preserve the safety end general weltare ofthe Citizens of the City of
Anaheim.
1. That this variance is grant°d subject to the comoletion of Re~lassificatio~ Vo.
69-~u-2.
2. That subject property shall be developed sutstar.t~al;y i~ accOrJ7r~:~ x~itt~ pl~~s
and specifications on file with the City of Anaheim, ma:ke9 Exhibit Nos. I. 2, and 3;
provided however, that a 10-foot easement .`or pedestri~n 3~~CP.55 to the ~roposed parksite shall
be provided alonn the westerly propei•ty line extendiny southerly from BaN~,vood Avenue to the
flood c;,ntrol channel; and further provid?d that revised plans reflect adequate access and
circulation for fire and trash vehicles as stioulated by the netitioner.
