A RESOLIITION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
T1iAT PETITION FOR CONDITIONAL USE PERMIT 1128 BE DENIED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Con-
ditional Use PermitFrom Tt"XACO, INCORPORAT£D, 3922 Campus Drive, Newport Beach, California 92660,
Owner; AVIS RENT-A-CAR SY5TEN6, 1508 South Alameda Str~et, Los Angeles, California 90021,
Agent of certain real property situated ir. the City of Anaheim, County or" Orange, State of
C~lifornia, described as the North 210~00 feet of the East 173.00 feet, measured along the
north and east lines of that portion of the northwest quarter of Section 26, Township 4
South, Range 10 west, in the Rancho San Juan Cajon de Santa Ana, as per map recorded in
Book 51, page 10 of Miscellaneous Maps, in the office of the county recorder of said county,
Beginning at th~~ north quarter corner of said section; thence South 967.99 feet along the
east line of said northwest quarter; thence North 88° 41' i5" West 117.70 feet to the
easterly line oE the right of way of the Southern Pacific Railroad; thence northwesterly
along said east~;rly line to the North iine of said section; thence East 363.87 feet to the
point of beginning.

WHEREAS, th~~ City Plenning Commission did hold a public hearing et the City Hall in the City of Ananeim
on July 28~ 1965~, at ~:00 o'clock P.M., notice of said public hearing heving been duly given
i: as required by law end in eccordence with the provisions of the Meheim Munic:pel code, Chepter 18.64, to hear
I end consider evidence fot and egainst seid proposed conditional use and to investigete and meke findings and
recommendetions in connection therewith; and
WHEREAS, seid Commission, after due inspection, investigetion, and study mede by itself end in its be-
half, and efter due consideration of ell evidence and reports offered et said hearing, does find and determine the
following facts:

1. Tnut the proposed use is properly one for which a Conditional Use Permit is authorized by Code: Section
18.52.050(1-a) to wit: establish storzge and rental of large trucks on subjeci: property with
waiver of:
SECTION 18,52.060(3-b) Enclosure of outdoor storaqe. (6-font solid
masonry wall required; none proqosedj.
2. That the proposed use will adversely affect i;he adjoining land uses, especially
the existing restaurant, wherein large trucks will be stored or parhed in the front setback
required of the M-1 zoned properties, with no proposed screening devices.
3. That the proposed use would establish an undesirable precedent whereby many
undesirdble interim uses could utilize service stations presently not in operation, as
well as operating service stations.
4. That the Planning Commission and City Council recently denied two petitions
requesting permission to have storage and rental of trucks at service station sites, and .
to grant subject petition would be granting a privilege not enjoyed by other service
station operators.
5. That service stations established in the M-1 Zone are only required to conform
with the site developmer,t standards established for servic~ stations in comm~rcial zones,
wherein minimal front setback landscaping and no interior landscaping is required; there-
fore, the use of a service station site not meeting the site development standard: of
the M-1 Zone for other indus•trial uses would be establishing a precedent for requests of
similar waivers of the landscaping and enclosure of storage area requirements of said zone.

NOW, THEREFORE, BE IT RESOLVED that thc Anaheim City Plenning Commission does hereby deny subject
Petition for Conditionel Use Permit on the besis oi the aforementioned findings.
